Klear ,

Hmm, it never occured to me it could be a generational thing. It was a thing on reddit, but there was also a lot of pushback and ultimately good sarcastic comments tended to survive. It feels much worse here, which I attributed to demographics.

snooggums ,
@snooggums@midwest.social avatar

The goal pf US prisons is the continuation of slavery with a heaping side of punishment.

Note that it is frequently named the Department of Corrections, or in this case Criminal Justice, not the Department of Rehabilitation.

givesomefucks ,

If your goal is rehabilitation

Why would a for profit prison system want to rehabilite anyone?

If the prison population dips below a certain point, they don’t get as much money, it’s literally in most contracts for prison services that the prison must maintain a certain number of prisoners.

The easiest way to keep them full, is to add charges for people already in prison. You do that by making their lives hell and putting them in situations where even a rational person would become stressed and prone to violence.

Even if they get out, they’ll be back.

Tldr:

The American prison system is designed for the opposite of rehabilitation.

It’s designed to maximize profits, and that means maximizes prisoners.

Nothing about the system makes productive citizens, because that’s not what makes the system money.

Glad they threw out her 5 year prison sentence from 2018 in 2024.

FlowVoid ,

For nearly the entire time, she remained out of prison pending the outcome of her appeal.

seth ,

So she only needs to sue for a farly partial time of duress and psychological trauma and loss of income from being imprisoned for a crime she didn’t commit.

FlowVoid , (edited )

Yes, she can sue. By law the most she can recover is slightly under $40,000, minus legal fees.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar

And here I thought everything was bigger in Texas.

FlowVoid , (edited )

It is!

AFAICT, Texas has relatively generous laws for recovery of damages after wrongful imprisonment. In addition to the payout ($80K/yr, prorated), you get an annuity. In some cases you can even get free tuition at a state university. Whereas in most states, you can’t sue at all.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar

$40,000 is not generous.

FlowVoid , (edited )

Hence my emphasis on “relatively”. That would be $25K in Michigan, and $0 in most states.

So technically, it is bigger in Texas.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar
FlowVoid , (edited )

The law is described incorrectly. They wrote (my emphasis):

The money was granted through the Wrongful Imprisonment Compensation Act, a state law passed in 2016 that grants a wrongfully convicted person $50,000 for each day that person was incarcerated.

But when you click on the link you find:

the court shall award compensation as follows: (a) Fifty thousand dollars for each year from the date the plaintiff was imprisoned until the date the plaintiff was released from prison, regardless of whether the plaintiff was released from imprisonment on parole or because the maximum sentence was served. For incarceration of less than a year in prison, this amount is prorated to 1/365 of $50,000.00 for every day the plaintiff

So by Michigan law he was entitled to $50K/yr, which is less than provided by Texas law ($80K/yr + other benefits).

And of course $50K/yr over 36 years is roughly the $1.75 million he received. If it were actually per day, he would have gotten over $600 million.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar

($80K/yr + other benefits).

Originally you said:

By law the most she can recover is slightly under $40,000, minus legal fees.

So which is it?

FlowVoid ,

She was incarcerated for a few months, not an entire year. The $80K/yr is prorated, so most likely she can get something under $40K.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar

You certainly didn’t make that clear. And even for a few months of wrongful incarceration (along with the years of having to spend time in court), $40,000 is pitiful. Absolutely pitiful.

“They don’t pay as much in other states” doesn’t make it any less pitiful.

Would you find that to be adequate compensation for destroying five years of your life for doing something that wasn’t illegal?

FlowVoid ,

I never said it was adequate.

I replied to the suggestions that it doesn’t matter because she already served her time (it actually does matter), that she should sue (she can but recovery is limited), and that everything is bigger in Texas (yes it is, relatively speaking).

Note that courts never compensate innocent people who are tied up in court, even for years. Compensation is only for people who are wrongfully incarcerated. Even in Texas.

ripcord ,

You certainly didn’t make that clear.

octopus_ink , (edited )

So what? That’s six years of a major life problem she did not deserve. 40k is horseshit (if she’s even successful in getting it awarded), no matter how it may compare to options in other states.

And I’ll say it - I don’t believe for one second she’d have had this over her head all this time had she been a white registered Republican.

After Mason was arrested in 2017, she lost her job at a bank. She was also sent back to federal prison for several months for being arrested while on probation for a federal crime. During that time, she almost lost her home to foreclosure.

“Although I’ve cried for seven years straight, seven nights a week … I’ve also prayed for seven years straight, seven nights a week. Prayed that I would remain a free black woman,” she said in a statement.

FlowVoid ,

I replied to the suggestion that overturning a five year sentence would be meaningless after six years. In this case it’s not meaningless at all.

Edit: you can look through my comments, I stand by everything I’ve said.

Cryophilia ,

Ah, I see. From what limited info you’ve given here, it sounds like you blew a common saying way out of proportion, but maybe I’m missing some of the more important context.

Jax ,

The context is children taking puberty blockers, which means taking them at around 12 years old.

The context is exactly what I stated it as, I have blown exactly nothing out of proportion. I gave them the opportunity to explain themselves originally, they declined by not responding, so tell me exactly what conclusion should I draw?

“Oh it’s fine that this person insulted me when I’m expressing my feelings (I cannot believe I just referred to being creeped out by kids taking birth control and fucking high schoolers as feelings), they deserve the respect they didn’t give me.”

Absolutely not, if the above is what you’re suggesting you can have these hands too.

Edit: I have to add, I did just randomly find this person again. I did not go out of my way to follow their comments. I just realized that might seem possible.

I… regardless, bringing this unrelated beef into this thread is a rude fucking thing to do to both them and us. Like i haven’t seen this level of pettiness in a good bit.

Keep it in your own thread. Isn’t that like a golden Internet rule?

Jax ,

🤷‍♂️ don’t say shit you can’t stand by

Cryophilia ,

I think it’s fair to bring up particularly shitty takes if you see someone in the wild. I do it with known trolls.

Cryophilia ,

kids taking birth control and fucking high schoolers

I think this is the issue. These are two separate statements and you’re conflating them.

“Someone didn’t get laid in high school” is a pretty common phrase that just means you’re lame. I think it’s a coincidence that the original topic was prepubescent puberty blockers.

The alternative is that someone just decided out of nowhere to proclaim their love for pedophilia. I think it’s far more likely that you misunderstood them.

Jax ,

My comment: My point is moreso that kids shouldn’t be having sex, but sure yeah. Read into it guys.

Their response: Sorry you couldn’t get laid in high school.

Really? So you really think this is out of context? When it is quite literally the context? I have a feeling I’m going to get snapped from this thread at some point so I sent you a DM.

Cryophilia ,

I do, actually. I mean really, take a step back and think about it. Why would someone just casually advocate for a sexual relationship between high schoolers and 18 year olds? That’s not how conversations work. That’s not how people work.

His point was just, “actually, kids do have sex, a lot, even if you weren’t aware of it when you were a kid”.

I feel like you’re trying to turn this into a pedophilia thing. It’s such a stretch. You misunderstood, and you decided that the worst possible interpretation was the one you were gonna go with.

JasonDJ ,

Jax took that comment way out of context.

The original thread was about puberty blockers being blocked by NHS when prescribed to kids with gender dysphoria.

At no point did a specific age come up, but it’s assumed that puberty blockers would be most effective before puberty.

However by this point in the thread, Jax had commented that they didn’t feel comfortable with kids taking birth control, a different tangent.

I responded, in sarcastic tone (and to a reply to Jax’s post, as in, to a third party), as if surprised to learn that people should be taking birth control or receiving HPV vaccines before they start having sex (as in, not when they start having sex).

Jax responds that they just aren’t comfortable with kids having sex.

I respond with the quote above, Jax replies with:

So you’re either suggesting that 12 year olds should be fucking high schoolers, or you’re just too dumb to think about what you said. I’ll give you a few minutes.

I don’t know where that leap came from, but it followed me here a day or two later.

AITA?

A lot of shitty things are done under the guise of, “It makes me feel uncomfortable”

Trans people especially, anything to do with them really, Oh I make you uncomfortable, guess we will just magically stop existing.

And for the uncomfortable people out there, most times the “stop existing” thing, comes in the form of unaliving because we aren’t cis like everyone else… that’s kinda the whole thing

Cryophilia ,

I think there’s a real Red Scare style trend among zoomers with regards to pedophilia. Any time they can find the slightest pretext to link someone to pedophilia, they’ll do it and then call a mob with pitchforks.

tabarnaski ,

The article doesn’t say this, where did you get that info?

Aleric ,

They made it up. I won’t be surprised if it goes this way, but there’s no indication that’s how it is now.

OldWoodFrame ,

You are making that up, nobody said it won’t be investigated and the case he was a whistle blower for isn’t being stopped by this.

Prandom_returns ,

I do hope you’re right.

I hope every single Boeing plane gets grounded until every single plane gets independently checked by a reputable 3rd party.

But my hopes are idealistic, and the real world is far from ideal.

Maggoty ,

The case isn’t stopped but it’s a lot less likely to succeed now.

And I’ll believe there’ll be an investigation when there is one.

TokenBoomer ,

We exported this in the 90’s. Russia learned it from America.🇺🇸
