athos77 , in Louisiana chemical plant threatens to shut down if EPA emissions deadline isn't relaxed

When the agency originally proposed tougher emissions limits, Denka had a longer timeframe to comply. But the EPA sued the company last year, finding the facility posed an “imminent and substantial endangerment” to the nearby community. [...] The company wants the EPA’s 90-day deadline put on hold and says the agency won’t consider lengthening that timeline until Denka sets out an emissions reduction plan, according to the filing.“ [...] (Denka) will need at least two years to plan, develop, test and install the controls required by the rule,” the company said in a court filing.

The EPA has been working on this rule since Biden took office. You knew it was coming, you just hoped there would be a change of administration before you had to comply with the ruling (so you wouldn't have to comply at all, which is also what you're hoping for with your current delay tactics). Sucks to be you - your lack of planning does not constitute my emergency, etc ....

cogman ,

Yup. Not only that, years earlier they were under investigation by the doj for their chloroprene emissions.

Denka’s arguments here are ridiculous. They are trying to play like chloroprene isn’t horribly toxic. It’s a human pesticide. No emissions are safe, and that means they can’t run their 60 year old cancer factory without rebuilding. Booo hooo.

The restaurant owner arguments are all super weak as usual.

"Menu prices will rise!"

No shit, but everyone was already paying the prices but now you can't just surprise patrons with the increase.

"There will be pullback. People will lose jobs and hours!"

Doubtful but even if true, that means that they knew they were lying to customers and clawing extra charges that they wouldn't know about already.

"'They' are thinking restaurants will absorb the costs"

Not exactly but they will have to compete with pricing as it should be.

They're just trying to get away with playing the same game Telcos have gotten away with for far too many decades.

brygphilomena ,

That’s what pisses me off, if the consumer knows what they’ll actually have to pay they won’t buy.

They are arguing that they should be able to lie to the consumer and trick them. They think the consumer shouldn’t be informed to make a decision on what is right for them. And once again, they are putting the business before the customer.

WindyRebel ,

Isn’t this literally bait and switch?

catloaf ,

No.

“Bait and switch” is the advertising of a product without the bona fide intention to sell it, for the purpose of establishing contact with a prospective customer in order to induce or “switch” him to purchase another product.

www.ftc.gov/system/files/…/Bait-Switch.pdf

WindyRebel ,

From the same source, further down

The existence of bait and switch schemes may also be evidenced by the following factors: whether in fact there were a significant number of sales of the advertised product at the advertised price;

Adding on hidden taxes and fees is debatably not providing the advertised price. Maybe? I don’t know.

uid0gid0 ,

What are the service charges that are being put on after the fact? From this I’m assuming it’s separate from the customary tip and any sales tax.

ElderWendigo ,

Many restaurants have started adding a “service charge” that is not a tip in addition to menu prices. It’s super fucking shady. There is rarely an signage indicating the charge, relying of the hostesses to inform you. It isn’t always clear on the itemized bill they hand you, since it’s grouped down with the tax. It’s not the standard gratuity added for large groups. There is a restaurant near me that suddenly started adding this kind of charge. They did not notify me when I sat down and I didn’t see any indication of it on the itemized bill and only noticed when calculating the tip, after they’d run my card. I made a huge stink about it because it’s a fucking scam and they did discount my bill, but they refused to remove the service charge. I liked their food, but that was the last time I visited and I stopped recommending them.

Kid_Thunder ,

I think what really kicked this off is that restaurants started putting surcharges on bills by directly passes specific legal requirement costs directly to the customers without increasing their menu prices. For example, now that servers get some health benefits in SF, they'll have a surcharge that says something like "SF Mandate" or "SF Health Surcharge".

This would also cover stuff like to go order surcharges where some places are charging more for takeout sort of like Doordash or Grubhub do, except of course, you're picking it up yourself.

I do wonder how/if places with some more traditional surcharges are going to comply now. For example pizza places charging delivery fees.

Places will still be able to get away with "X% gratuity added to bill for Y seats (though I've seen some places do it for any number of people, including 1)" because that's optional, even if they put it on your bill because you've always been able to make them remove it.

It is like on most people's cell phone bills in the US. You'll see stuff like "FCC surcharge" which is the company passing their FCC regulatory fees directly to the customer without changing their advertised prices for a plan, E911 fees for 911 services, various taxes levied on the company but not the consumer are also passed to the customer.

The purpose is to have restaurants take these fees/taxes/whatever and make them build those costs of doing business directly into their advertised pricing on their menus. Companies don't like this because they can advertise cheaper prices and psychologically the customer doesn't usually think or even know about the extra surcharges, companies can set those surprise charges to whatever they want (they aren't regulated) and they do not have to really compete with those prices wherever they advertise (menus, flyers, etc.) thus driving them down for the consumer.

GrymEdm , (edited ) in Pro-Israel Agitator Shouts ‘Kill the Jews,’ Gets Everyone Else Arrested [Edith Olmsted | Apr. 27, 2024 | thedailybeast]

Pro-Israeli interests have sometimes settled for manufacturing a helpful “truth” when it doesn’t exist. The latest version seems to be that protesters are widely violent, hateful, and make campuses/cities unsafe. Here’s a 4-minute message from a Jewish Holocaust survivor about his time in the front lines of pro-Palestine protests: “When the right-wing section of the present government is trying to press for the banning of these marches on the grounds that they create ‘no-go areas’ for Jews and they are anti-Semitic - we know that this is complete rubbish and the very opposite is true.” He encourages “the brave student protesters” to keep going, and talks about how well they have been treated and celebrated even while wearing placards that identify them as Jews.

Here’s a Jewish Londoner talking about how he’s been attending UK pro-Palestine/ceasefire marches for months with a large Jewish bloc and they’ve “been received very warmly”. The interviewer then disagrees with him, telling him that he’s in danger and the marches are anti-Semitic in spite of the person who’s actually been going to months of protests saying it’s the opposite.

Here’s a video of a woman who walked into the middle of a protest calling 911 and trying to invent a dangerous situation while everyone around her keeps their distance and assures her she is safe to leave.

Here’s a study about how false claims of crimes hurt the cases of, and empathy for, real victims of crimes. Similarly there are real anti-Semites out there, and there are true cases of racially motivated aggression against Jews. However, such obvious attempts to invent anti-Semitism is “crying wolf” and damages the credibility of genuine allegations by making it easier to believe it’s made up. The people trying to manufacture the situations they claim to fear need to examine their commitment to truth and the harmful impact of their obvious deception. On the protesters side, it’s good they are booing and otherwise publicly rejecting anyone who steps over the line into hatred (whether genuinely or as a false flag). That’s something they absolutely must stick to in order for the protests to stay ethical and also to avoid being discredited as racist.

BertramDitore , in DeSantis signs bill banning local heat protections for workers
    @BertramDitore@lemmy.world avatar

The bill’s passage comes after the state’s most populous county, Miami-Dade, considered local heat protection rules that would have been among the most stringent in the country. That proposal would have required employers to provide shade, water and 10-minute breaks to workers every two hours on days over a certain heat threshold.

The fact that that would have been among the most stringent protections in the country is incredibly sad. Those protections should be in place nationwide by default at a minimum. Nobody benefits from overheated workers, who are human beings by the way. I feel like it’s so much easier to just be decent and take care of peoples’ basic needs.

You’re a monster if you don’t think your workers deserve to have a few minutes in the shade whenever the fuck they want. People will work harder if they feel like they’re safe and respected. Everybody wins.

    yeather ,

Companies provide all of these to workers already, it’s to illegal workers being exploited this bill would benefit and who Desantis wants to kill off.

    AncientFutureNow ,

    source for your claims?

    yeather ,

Have worked for a few companies where I needed to be out in the heat. All three had mandatory heat breaks for 10-15mins every two hours over 90F. All three also provided water and a shaded area.

    bradorsomething ,

    In Miami-Dade?

    yeather ,

    And counties around it.

    bradorsomething ,

It’s hard to understand how what you said - and a county mandating these changes - come together. A city actually voted on this issue, they don’t do that because there’s nothing going on; it means this is a pressing matter in their area. Companies clearly aren’t providing breaks if a city actually votes to mandate this.

    Adm_Drummer ,

I’ve been told that the armies in many countries use sliding scales of work-rest cycles based on temperature and humidity. For example in Canada, above 35°C you may only have half the crew working 30 minutes on 30 minutes off. Meaning you have 50% of the work being done 100% of the time. Hydration and heat stroke checks are strongly enforced as well. The American army does similar if I’ve been told correctly.

How American civilians and labourers are not allowed these very same standards is insane to me. People die because of this shit and unions are just okay with this?

    homesweethomeMrL ,

Most workplaces are not unionized, and most states are “at will” employment meaning anyone can be fired at any time for anything.

    Adm_Drummer ,

Okay, sweet. Then that’s identical to the system I’ve been told about for Canadian Forces and similar to what I’ve seen with other militaries. Crazy how that works. Especially seeing American states that are so pro military and anti-labour fail to meet the basic criteria even the DoD follows.

    Zorsith ,
    @Zorsith@lemmy.blahaj.zone avatar

Maybe NATO related? Then again, the US military is fairly invested in keeping their troops functional. Cant dissuade too many people from joining up, it’s the biggest socialist program the country has to offer…

    Adm_Drummer ,

It very well could be NATO doctrine. Militaries figured out real quick that you have to keep troops alive long enough to fight. Whereas it seems civilian workers are treated worse.

Funny how the military, being an innately fascist system (meritocracy) also happens to be the most socialist system many countries have. Room and board, fair wages, a viable path to promotion, medical care all in return for your work and possibly your life.

The military radicalized me to democratic socialism.

This is one of those things that hurts the “right” people.

    ChocoboRocket , (edited )

I used to be like you, and ultimately I still am - but people seem to need this oppression if we’re ever going to make government work for us again.

There is a very dangerous trend of voter apathy, mis/disinformation, and a near complete lack of understanding on the functions of government and democracy.

Until people are actually willing to “work together” (decide we don’t need an orphan crushing machine - not actually work hand in hand with everyone else) we kind of deserve the governments we have.

It’s plain as day that powerful interests are getting absolutely everything they want, while successfully convincing the general population they shouldn’t have job security, health care, social safety nets, education, and an environment that isn’t entirely poisoned.

So many people are willingly voting against their interests to hurt someone less well off. Others simply don’t care to pay attention, vote, or refuse to apply logic to information if it suits their bias even though it hurts them.

There are huge amounts of bad actors (media in general completely ignoring the obvious rise of facisim and ringing the dinner bell instead of the alarm) doing everything they can to obfuscate the truth and play on people’s bias/hate/fear are direct attacks on democracy.

It feels like we’re literally experiencing how Hitler rose to power. People are aware of things like project 2025, J6, Christo facisim, bought and paid for supreme Court, outright lies and disinformation campaigns from most media sources, and billionaires dictating to governments.

The general population mostly shrugs, does a finger wag, a head shake, and call it a day.

The far right is organizing globally to allocate funds and think tanks, lobbyists, controlling media, having people of influence throughout government, military, and police. The response? everyone still treats them as disconnected fringe weirdos doing their thing, not something worth dedicating any time to.

You hear Trump supporters saying J6 was an inside ANTIFA FBI job of fake actors - who are completely innocent American heros that are political prisoners and need to be pardoned? Such cognative dissonance shouldn’t be able to exist in nearly half the population, but does due to trusted sources experiencing 0 consequences for pushing obvious lies - so it must be true.

When push comes to shove (shove comes to fist?) maybe the Lazy left will actually show up to resist their oppression, hopefully they unite before it’s too late.
