Is it just me or does 30 years to life seem longer than you would expect? I’m not trying to argue what he deserves or what the correct amount of time is for rape. I’m just saying that if I had to guess what kind of sentence someone would get for 2 counts of rape, I’d have guessed something like 15 years at most. It seems especially unusual given that he’s rich, white, and presumably a first-time offender.

If the sentence is unusually long, would that mean an appeal is more likely to be successful?

After the rapist Brock Turner was given a slap on the wrist, California passed mandatory sentencing for rape.

He was accused of 3 rapes but convicted of 2. He received the maximum sentencing for each.

His lawyers are likely going to fight the conviction constantly until the money runs dry.

My personal thought is the conviction is unlikely to be overturned but a sentence reduction is likely. So he got the maximum sentence. Danny will likely be behind bars for at least 6-10 years for his crimes.

That’s the right Brock Turner who was sentenced to 6 months and was released after 3 months. Judge Aaron Persky thought a longer sentence would unduly harm the rapist, Brock Allen Turner.

I knew about Brock Turner, but I didn’t know California passed new laws as a result. Do you mean mandatory minimum sentences? Or was the maximum raised too? Would 15 years have been illegal for Turner, but is legal for Masterson?

6-10 years for his crimes.

6-10 years is more what I would have expected given his fame and wealth. I wouldn’t have been surprised at 15. But, 30 to life seems more like what I’d expect from a second-degree murder sentence for someone with a criminal history, not rape by a rich white Hollywood celebrity.

There were several aggravating factors here. A long sentence is surprising given that he is a wealthy, white man. But it’s absolutely justified (in the current carceral context, of which I strongly disapprove).

    It varies a hell of a lot by state. Some states will give 40+ years for one rape, some will give under 10 years for multiple rapes. Add in the biases of individual judges, the person being charged, their status, jury biases, etc, and it ends up kinda all over the place.

    Sentencing has never made much sense. Depends upon jurisdiction, how many charges prosecutors can tack on, how many you end up going to trial over, how many you get convicted over, and who is responsible for sentencing (in some places the jury sentence, in some the trial judge, in others sentencing is a separate proceeding with a separate judge).

    One of the big factors here is that Masterson and his lawyers still deny everything. He didn’t cut a deal, hasn’t shown remorse since he hasn’t admitted to any wrong-doing, and the judge chose to sentence consecutively. First trial was a mistrial, second trial got 2/3 convictions, and apparently they intend to appeal. So depending upon appeal, he is currently facing somewhere between being acquitted on appeal to facing life in prison. In a lot of cases like this, some sort of deal is cut on lesser charges or lesser sentencing in exchange for admitting guilt and not dragging this on through appeal, hence typically shorter sentences. Masterson/his lawyers are instead rolling d20s and the current outcome is a 1.

    Yea, I’m glad he is getting what he deserves but 30 to life seems insane. You can get up to 20 years for murder here (life sentence is possible but only for the rare serial/mass murderer), and getting that 20 years requires you to do some really bad shit. Manslaughter for another example is up to 3 years.

    Yeah, seems high. I’ve known someone that got 10 years for attempted murder (shot someone). I’m not in favor of long sentences like these in general. If a person is not going to rehabilitated in 10 years, then I don’t think adding another 20 years is going to help. Same thing if you look at it from a deterrent perspective (if 10 years isn’t a deterrent, then any sentence probably wouldn’t be). If a person could never be rehabilitated and they would pose a danger to others if released, then a life sentence would probably be the best.

    I don’t think /u/Ilovethebomb was trying to defend it. He’s just adding context. She didn’t only get shot for shoplifting. The shoplifting initiated an interaction with the police that escalated. She started driving away and the cops tried to physically stop the car with their bodies. So one of the cops panicked and shot.

    Of course there are many issues - why were the cops pointing guns at her in the parking lot while she was in the car? Certainly didn’t help with de-escalation. I hope the cop who fired the shot and is under investigation gets criminal charges.

    Exactly, saying things like she was “murdered in cold blood” doesn’t help anyone, because you’re that far off the deep end nobody outside of your echo chamber will take you seriously.

    There have been a few people reply to me saying that, despite what happened, the police could and should have done something different. And they’re probably right, I don’t know how we got from shoplifting to this, but there were probably opportunities to defuse the situation.

    But calling her innocent is simply untrue.

    But she didn’t even commit shoplifting, she was wrongfully accused and the car rolled after she was dead and her corpse failed to keep pressure on the brake.

    Literally the only thing she did was fail to comply with demands to exit the vehicle and turn the steering wheel in an attempt avoid the officer before being shot.

    So what she did was not listen violent and angry people who have full privilege to shoot indiscriminately and was shot for it.
    I can pretend she did nothing wrong happily, because she barely did anything at all other than be a victim.

    That is undoubtedly why the Marion County Attorney has now withdrawn the search warrants because, to use his own words, ‘insufficient evidence exists to establish a legally sufficient nexus between this alleged crime and the places searched and the items seized.’

    Anyone who’s spent time as the focus of the police or around our court system is aware of what a joke search warrants are. The police just need to claim they have a confidential informant who saw something. That’s sadly enough in most of the country. Funny, the CI is nowhere to be found when they don’t find anything on the search and it’s the warrants credibility is questioned by someone with enough money to have a lawyer investigate. Then if they do find something someone who needs a minor charge to disappear definitely saw whatever needed to be seen for the warrant. It’s insanely corrupt. The unreasonable search and seizure part of the US constitution is violated hundreds of times a day.

    “Cancels” is the wrong verb again. ABC can cancel it, Trump can only decide not to show. ABC and Kamala can go ahead and have a debate with the audience or even put a cardboard cut out in his place and play random quotes he’s made and let Kamala disagree with them.     Let’s be real, close to a majority of Americans have no issue with their iPhone being used as part of a mesh tracking network, even if it helps abusers with airtags.

    All they have to do is sell this to people as benefiting them, and they will gobble it up. Hell, chances are, insurance companies will start offering reduced rates if you drive one (and then they buy the data from Ford and increase rates with it).

    The massive difference between AirTags and this is that AirTags (and the whole Find My network, it’s not only AirTags after all) actually provide a useful service to each participant, namely locating their things if they get lost somewhere. This does effectively nothing for you and will only ever fuck over other people (you could argue rightfully so, but still) and provides no value to anyone other than the police.

    They all have telematics in their trucks, and I know they all use the data in the case of accidents to prove fault. Amazon specifically monitors speed and will fire drivers if they do it too much. Wouldn't surprise me in the slightest if they started sharing that info.

    That’s just another tactic of projection. Republican woman are just mad that they aren’t men and need to justify their own subjugation by ensuring they get second place in the social hierarchy instead of questioning why there’s a hierarchy in the first place. Thinking for yourself is difficult, so being told what to do is easy. Even if that means being told to hate yourself. Hell Christianity’s first chronological story boils down to “women are the reason life sucks.”

    I do okay financially; if I wanted a new car, I’d buy one. I bought mine brand new off the lot 15 years ago, and I intend to keep driving it until I can no longer repair it. Why would I possibly want to buy a new, 5G-connected, spyware-infected plastic shitbox when what I have works perfectly well and probably has another 100k miles of life with a few minor repairs and maybe an engine swap at 2-300k or so?

    CarPlay and radar cruise control are worth it for commuting imo… but beyond that I don’t care.

    I frequent the Bay Area (Cali) and wouldn’t dream of taking a car without some semi-autonomous driving features. Sitting in traffic while the car brakes, accelerates and steers is the best.

    It’s takes sometimes an hour to go 15 miles up hills on 680 in the bay. My competition clutch car can help me enjoy the canyon roads, but my “self driving” car can take care of my “grindset” driving.

    Only reason I am thinking of replacing our car is because a BEV would pay for itself fairly quickly if I hear back from a job I applied to that has a 50 mile round-trip commute. Gas alone would be an extra $1000 per year compared to our current 11 year old vehicle.

    For sure. I had my last car for 20 years until it finally NEEDED to be replaced. And my current car I’ve had for five years. After paying it off early, I’ve enjoyed not having that payment, and I hope it lasts just as long as my last car.

Some notable ones are Nissan and Kia collecting information on your sexual activity and six companies collecting your genetic information all for what?     Not wanting unnecessary “features“ that are just thinly veiled spyware that overcomplicate every aspect of driving is not a boomer opinion. Wanting buttons you can feel without looking for instead of a giant screen that has automatic updates and needs to have access to your cellphone for basic functionality is not a boomer opinion.

    Knowing that tacking voice activation onto every ‘smart’ device, including vehicles, is just an excuse for companies to record everything you say for their shitty marketing isn’t a boomer opinion.

    In my experience doing tech work, boomers love that shit and fall for all of it, and it all fucks up in some way much more quickly than should be allowed.

    My 2010 Passat Wagon has 211000 Miles and is about to get its first set of new shocks/struts. some big things I had to replace were the mechatronics and rebuilt the cylinder head. Cylinder head was because I ignored a timing issue with the chains. Chime in if you have high mileage.

    Car payments are a poverty trap. I haven’t had one in a decade. Buying a used car for cash is such a better deal anyway. I do need suckers to get those 1-2 year leases though to make my cars cheaper.

    I imagine that leading up to the election, they don’t want to show a pattern of unsubstantiated false election claims, since that can be used as evidence if later there is a claim by a host or guest which names a company directly that can be used in a lawsuit.

    If such a lawsuit were to happen, they can point to this instance and claim that they tried their hardest to stop the unsubstantiated claims (even cutting off the former president), and it’s not a systemic issue in the network.

    If Fox decides to malign corps or non-public people, then they may be sued. You can lie about the President and DOJ all day without commuting a crime or standing for a lawsuit.
