“But we have to determine if he [Will McDonald] was justified in doing what he did"

Really. Are we relieving shooters of the burden of making sure of what they’re shooting at or do we just give people a pass?

jordanlund ,
@jordanlund@lemmy.world avatar

Forget making sure, even if it WERE a car prowler, that’s still not a justified use of force.

giffords.org/…/stand-your-ground-in-nebraska

“Nebraska does not have a stand your ground law. State law explicitly imposes a duty to retreat before resorting to deadly force outside the home.2”

nebraskalegislature.gov/laws/statutes.php?statute…

“The use of deadly force is justifiable when the actor believes that such force is necessary to protect himself or herself against death or serious bodily harm unless the actor knows that he or she can avoid the necessity of using such force with complete safety by retreating. Newton v. Huffman, 10 Neb. App. 390, 632 N.W.2d 344 (2001).”

Thanks.

I really don’t like the trend in some states that people seem to be able to kill over theft, or even arguing over a parking space. It’s nuts how little life is worth.

@jordanlund@lemmy.world avatar

“ABLE” and “ALLOWED” are two different things. ;)

Anyone armed has the ability… they’re just going to get charged in most cases.

RememberTheApollo_ ,

Lots of good that distinction does the dead person.

Fondots ,

I work in 911 dispatch, so I often get to spend a large portion of my night listening to the absolute dumbest reasons imaginable that people get into fights, and an amazing of them could be avoided by someone just walking the fuck away or closing a door.

A couple of highlights

I get a call from a very angry person. They wanted to park in a space that someone else was parked in. Other party was sitting in their car. This wasn’t reserved or permit parking or a private lot or anything of the sort, just public street parking in a fairly busy downtown area, and I don’t think it was even time restricted or metered or anything like that. Caller had asked them (and from their tone with me, I suspect they didn’t ask politely) to move so they could park there. Person sitting in the car told them to say please. They get into a bit of a shouting match, and I end up having to send a cop out to get 2 grown ass adults to say “please and thank you” to each other and explain what street parking is. I’m tempted to side with the person in the parked car because the caller was an asshole to me, but the truth is they both suck, either one of them could have just driven away at any time and not had to make it anyone else’s problem.

Another one was a domestic. We got calls from both parties, my caller was inside the house, their ex was outside, and they were arguing through the open door. I get all the info I need, told them to close the door and stop arguing with their ex and just wait inside until the cops got there, and went on to answer my next call. Couple minutes later I see that we now have EMS going to the house. Apparently at some point after I ended my call, they opened the door to continue arguing and got pepper sprayed. Wouldn’t have happened if they just kept the damn door closed like I told them to.

Another time my caller had just gotten off of a bus and was following a group of teenagers who had threatened him with a knife on the bus. I told him to stop following them because they have a fucking knife. This bonehead tells me it’s ok because he has a knife too. Motherfucker, I don’t want any of you idiots getting stabbed. They’re walking away, let them walk away. If you have the option to not get into a knife fight, take that option. Especially don’t get into a knife fight with a bunch of teenagers.

Those are probably the most obviously insane ones, but I’m pretty hard-pressed to think of more than a handful of disturbances or domestics I’ve had where both parties were totally unable to separate from each other. Close your door, go to your separate rooms, roll up your windows, just fucking leave and go for a walk or a drive, whatever it takes, just stop escalating the situation.

There are some times where standing your ground can be justified, but I think there’s far more cases where people should have a duty to retreat instead.

RememberTheApollo_ ,

Then they don’t understand why whatever happened to them when they couldn’t leave the situation. Being right (in their mind) is more important than being alive, I guess.

afraid_of_zombies ,

I am in my apartment and hearing banging and yelling. Come out and my neighbor is in the hallway. Banging on his door demanding his gf let him in. Shows me his watch and said they had an argument and she smashed it. We talk for a bit and I suggest he spend the night with a relative even offering to drive him. He doesn’t want to, wants to continue to bang on the door and resume the fight. I get frustrated and tell him (this is as best as I can remember it) “you are a 19 year old black kid having a domestic with like 40 people who can hear you. How do you think this is going to go for you when someone gets angry enough to call 9-1-1? And lord fucking help you if one of those drug sniffing dogs barks one time. Now do you want to continue in this hallway until that happens or do you want to chill with me until your grandmother picks you up?”

What is wrong with people? Take a walk and calm down before it gets out of hand.

Hillock ,

At this point in time, it doesn’t appear that he was justified in firing.”

Maybe put the rest of the quote in there. And are you really mad at the police for doing their job of investigating what happened and following the principal of "Not Guilty Until Proven Guilty".

RememberTheApollo_ , (edited )

That doesn’t change the point of my opinion. Put the rest of it in there seeing as you prefer more information - the part where he shot a 10 year old. So he didn’t verify what or who he was shooting, and yet we have a public statement that that even considers it could have been justified? I’m all for presumed innocence, but when you whip out deadly force you’d better be damned sure what you’re planning on killing and the consequences for doing so, and I have little tolerance for failure to do so.

/jordanlund has offered legal standards that would seem to make the shoot unjustifiable regardless of presumed innocence.

paddirn , in Recognizing fake news now a required subject in California schools

I don’t like the headline description of this because I really hate the term “fake news”, given who originated it (or at least who popularized it). Reading the article though, CA seems to refer to it as “media literacy”, which seems more apt, that or “critical thinking skills” would be so much better. Just anything other than the term “fake news”.

In the modern context (2010s), it came into use to describe articles from organizations that called themselves news outlets literally making up fake stories. The right co-opted the term to apply it to anything they don’t like because they disliked serious journalists calling out right wing talking heads and here we are.

the bits and pieces required to recognize 'fake news' should already be a part of a required curriculum at a public high school; and i do remember some exercises in one class in particular that compared tabloids to mainstream newspapers. this was in the 1980s, in a fairly progressive part of minnesota.

This is what all that "doing it for attention", "pronouns suck" and "groomer pedo" talk amounts too. People so scared to live that we have a dead body instead.

I hope she is at peace.

rurutheguru ,

Unfortunately the “shame” surrounding these things stem from the concept of sin and living as a “sinner” in a “fallen world”. I’ve been shamed countless times because of things the church did not agree with. I don’t know if he ever preached any transphobic ideas in his time, but biblical ideologies are rife with gender roles and toxic ideas about women and masculinity. Even if he didn’t preach any of that toxic garbage, he must have been struggling a lot with his own identity, even though he said it’s only for fun and stress relief (paraphrasing). Small towns don’t act gracefully towards people experimenting with their sexualities like this. Can only imagine the rejection he must have experienced having all of this play off on the grand stage of his life in that little town, since literally everyone there knew him.

That's tragic, heartbreaking and a good question to ask.

But unfortunately I think the answer is yes. Bigots are happy, any queer death is a reinforcement that their methods work. All are so quick to say "trans people are mentally ill" and the immediately do their best to make that person's life a living hell, which is some twisted cruel logic. They don't want us to exist, they call to exterminate us from public life and they think by making our lives difficult enough we can be shamed in to non-existentance.

We can't let them win. Because victory is literally death, but we will always have to remember those who fell, honor their memory and use their tale as a warning against every piece of shit conservative bathroom bill deadname enforcement and trans healthcare blockade. Because unfortunately, trans people as a whole are very directly under attack. Please vote accordingly.

Mate, get a hobby that doesn’t involve trying to make strangers on the internet upset. You have a very limited amount of time on this earth and are you really going to look back on your life one day and be proud that you pissed off a bunch of random strangers by saying stupid shit?

Probably not right? So maybe spend your time on a project you’ve been putting off, or teach yourself a new skill, or get a new hobby and make some new freinds, you will have such a more gunnery fulfilling life you look back on and be proud of if you do.

    cricket98 ,

I think you are projecting a bit. I’m fine and live a happy life with my family with a good job. I’m allowed to post my opinions to the internet. If that pisses you off, I don’t know what to tell you. Keep it moving and stop responding if it bothers you so much. But I bet I will receive another response because you lack impulse control.

    gmtom ,

I’m not angry, despite how desperately you want me to be, nothing in my responses even shows signs of anger.

And I dontbhage you, despite how much you want me to, I just pity you.

If you really have a family you are happy with, would you not rather spend your time with them? Making nice memories instead of trying to get a reaction out of strangers on the internet?

And I’m not going to block you just yet because I feel like there is a chance, however small, that I can actually get through to you, even if you want admit it to me directly, and make you realise that annoying strangers on the internet is not a productive use of your time and that you could be doing something better. Something that makes you and others actually happier and more content instead of just spreading mild annoyance eith your ““debates””

    cricket98 ,

I post on an internet forum when I’m alone after work. Lots of people do that, except you’re trying to paint it as a moral fault just because you don’t like the topics I am discussing. Cut out the preachy “I’m just trying to make you a better person” bullshit that you’re trying to use as justification for continuing to respond to me. You haven’t made one salient point other than whining. And I had you on the mark about poor impulse control.

Complete layperson here but it kind of astounds me that we haven’t cracked the code for this friend-or-foe identification. One would think there is some identifier or expression that is evaluated by the immune system and if we could match that we’d be golden but clearly not that simple.

    jballs ,
    @jballs@sh.itjust.works avatar

I started reading the book Immune by the team that runs the Kurzgesagt (In a Nutshell) YouTube channel. Surprisingly, things become simpler when there are more eyes looking at them. The more esoteric something is, the harder it will be to grasp because there are fewer resources to help you.

    thenightisdark ,

Our bodies are just winging it. It’s both beautiful and goodness and all kinds of other things but it’s a bit philosophical at times.

I had ITP. Autoimmune something which means they don’t know what caused it but my body stopped acknowledging that parts of my blood cell, not the entire one just a piece of it, we’re not me. Of course not me gets flushed out.

But the fancy words for part of a blood cell is called a platelet if you don’t have any platelets you don’t clot. As you can probably pick up not being able to clot is a big problem. I was in danger of bleeding out because my body decided to take out all my platelets.

Seems like an easy problem. If a whole blood cell is me because the DNA matches and all kinds of other things, obviously one cell of me is one cell of me. But if you take one cell of me and you break it up into pieces is it still one cell of me? By definition is not it is 50% of me…

So one cell of me is obviously me and one cell of you is obviously you but what happens when we get into percents at what percent does my cell stop becoming me?

    SomeoneElse ,

We can’t even cure autoimmune diseases yet. Why the fuck has my immune system decided my own tissues are the enemy?! Such a dick move.

    stella ,

    Fair enough.

These are very complicated processes that are difficult to interpret with such a (relatively) small number of people looking at it.

    Elivey ,

Taking immunology right now, it’s incredibly complicated. Immune cells aren’t like any other cells in our bodies, they’re absolutely bonkers.

    I_Has_A_Hat ,

We already know the solution, the technology just isn’t there yet.

The solution is lab-grown organs. You don’t need to worry about rejection if the cells come from the patient themselves.

And… That’s really it. With how insanely complicated and individually tailored our immune systems are, it’s easier to find a way to grow an organ than it is to find a way to guarantee compatibility with a donated one.

    BlindFrog ,

    Cue The Island, lol

    LilB0kChoy ,

    Dazza ,

  • LilB0kChoy ,

That’s not actually how it works. Rejection of a transplanted organ means the body is developing antibodies against the organ.

Successful dosing and continued use of immunosuppressants inhibit the body from “rejecting” the transplanted organ(s).

I suspect you’re operating off a commonly held idea that transplanted organs have a “shelf life” but that’s not really true.

It’s important to keep in mind that transplanting organs is still comparatively new medical science (only about 70 years old) and that transplants are often for older patients or patients with other underlying conditions that caused the original organ failure to begin with.

The worst part, from the article:

After the hearing, Emanuel and roughly two-dozen supporters congregated around his truck — a white Ford F-250 donning a Confederate flag.

The people who he tried to kill asked the court for mercy. He then goes outside to receive the support of fellow racists.

But like, why does it fucking matter? If I were a player, I’d still rock the pride jersey and tape in the face of the ban. “oH yOu NeEd To RePrEsEnT tHe CoMpAnY!”

Fuck you and your hateful bullshit. I’ll show my support even though you won’t.

    MacGuffin94 ,

Really there is only like 10 players that need to say fuck it and not follow this to force Bettmans hand. If Crosby, McDavid, Matthews, or a handful of other players of their popularity and caliber use the tape during warm-ups or singing like that it really puts pressure on the NHL to fold.

    2. Since it’s allowed, why aren’t Dems taking advantage of the old switcheroo and packing every race with temporary conservatives only for switching back once elected? That would be the funniest thing.
