Piers , in Donald Trump warns of threat of World War II, mixes up names of Joe Biden and Barack Obama in Washington speech

For those who didn’t read the article, Trump claims Biden is too old and senile to be trusted to run the country then proceeds to confuse WW2 and WW3, then confused Biden and Obama and then immediately after confused Hilary and Obama (ie, the headline slightly understates it if anything.)

adeoxymus ,

Here’s the citation:

“The radical left thugs have weaponised law enforcement to arrest their leading political opponent … leading by a lot … including Obama,” he said before catching the error and trying to get back on track but appearing to forget that it was Hillary Clinton he beat in the 2016 presidential election.

“I’ll tell you what … you take a look at Obama and you look at some of the things that he’s done, this is the same thing, the country was very divided and we did with Obama, we won an election they said that couldn’t be won.”

It made no sense to me, I thought I was used to how this guy speaks. I listened to the video. It’s the same thing. makes no sense.

Rain outs like this are pretty common at these festivals. The difference here is that I guess it is a bit harder to leave and more remote? I’d say 20% of the festivals I’ve been to have had some degree of mud issue resulting in some degree of infrastructure breakdown.

ultranaut ,

Burning Man is in a dry alkali lakebed way out in the middle of nowhere. Normally it’s extremely hot and dry the entire time, the ground isn’t dirt but a very fine powder that blows everywhere. When it rains that fine powder turns into this incredibly sticky mud and it becomes extremely difficult to move. It’s quite a bit different than your standard muddy field kind of experience.

KevonLooney ,

It’s almost as if 70K people shouldn’t be out there…

DLSchichtl ,

Why not?

KevonLooney ,

Because there’s no infrastructure, leading to less than an inch of rain causing chaos? Did you read the article?

Rediphile ,

This mindset leads to no one doing anything interesting ever.

Skiing, sailing, scuba diving…none of it makes any real sense as the environments do not tend to have much infrastructure for human survival. But I can’t imagine life without any illogical recreational activities such as these. It’s fun.

KevonLooney ,

Do you… think people don’t live in the mountains? Or that a tiny amount of rain will sink a boat?

That’s… only something someone from Southern California would think. Rain won’t hurt you unless you stupidly pack tens of thousands of people into an area with no infrastructure.

jimbo ,

They brought plenty of “infrastructure”. Shelter, generators, food, water, sanitation facilities, etc. Yeah, the mud sucks, but you’re really being dramatic about the situation.

MossyFeathers ,

While I agree with this, I think the festival is big enough that they need to start considering improving the roads. Even just slapping down some plywood sheets where the roads are would probably be better than what’s currently going on. This time it sounds like everyone’s gonna be fine, but what about next time?

Puzzle_Sluts_4Ever ,

Did a quick google. Can’t tell if the unpaved rural road is the full 10 miles, more, or less. But even at just one or two miles, that is a LOT of “plywood” that more or less is only usable once before being ruined by the time it is required next year. Let alone if you have dumbasses in overly heavy vehicles (and you would never have that in the US…) who break the plywood and render the road even more unusable.

As for paving? Sorry, but fuck that. So much infrastructure is underfunded and needs work that I don’t want a single tax dollar wasted on a road that is pretty much used twice a year.

I am a climber and enjoy going camping. I spend a LOT of time on unpaved roads and the like. Guess what the first thing we do before heading out the door on a trip is? Check the weather. Guess what the last thing we do before leaving the supply town is? Check the weather. And guess what we do “at some point in the day” on every day of the trip? Check the weather.

And if at any point in the trip the weather looks dangerous? We go home (or find somewhere else nearby we can do stupid shit at).

But, because this is Radically Inclusive ™: It is the government’s job to protect these rich assholes

Rediphile ,

I was talking about things like backcountry skiing, which I do for fun. But I’d even apply the same to a ski resort where bad weather can shut down gondolas and leave people stranded up top. And while SoCal sure sounds nice, I actually live in the mountains myself… in Canada. A place where unexpected heavy rain actually washed out a few highways last year and leaving many people stranded in previously well connected communities. Similarly, unexpected inclement weather does sink recreational boats somewhat often… which is exactly what the situation at burning man is: (very) unexpected weather.

My point was that it is a ‘for fun’ event in an environment not meant for humans to set up permanent infrastructure, and that’s ok.

merc ,

Apparently because it’s alkali dirt, it leads to nasty wounds if it stays on skin for a while. Even in a dry year, people were supposed to use vinegar to clean dust off themselves so it wouldn’t cause problems. Who wants to bet that many of the people covered in mud didn’t have enough vinegar, or maybe didn’t even have any.

I think the point of the comment was that in the last few decades the rhetoric has been: “Taxes bad” “Government provides free bus passes to underprivileged people” Always divorcing taxes from their positive effects on society. Maybe they were trying to fight that by directly uniting the fact that the government is just a coordinator, collecting taxes and using it to buy lunches for kids.

“4% tax on millionaires pays for breakfasts and lunches for all school children” unlike the above example, is a sentence that reminds people that taxes are what provides these many positive social benefits they recieve, not “the government”, not “for free”, and that taxes aren’t always “bad”.

vettnerk , (edited ) in Texas Judge Says Doctors Can Use ‘Good Faith Judgment’ in Providing Abortions

Who holds the burden of proof, though? Will the doctor have to prove that his choice was done in good faith to claim that his procedure was lawful, or will a prosecution have to prove bad fath? It might seem like semantics, but I bet a lot of doctors will be risk averse if they hold the burden of proof.

    echutaa ,

Regardless this seems like it will just be used by the state/wealthy organizations to drag doctors through court until they’re out of money. If I were a doctor in Texas I still wouldn’t even consider an abortion for fear of losing everything.

    girlfreddy ,
    @girlfreddy@mastodon.social avatar

    @echutaa @vettnerk

If I were a doctor in Texas I would be leaving Texas asap.

    Same for Florida.

    thepianistfroggollum ,

Prosecution always has the burden of proof in criminal cases.

    andrewta ,

Does the prosecution hold the burden of proof? Yes

Can a defense attorney technically sit there and say nothing during the entire trial? Well technically yes. Because the burden of proof is on the prosecution.

But the reality is the prosecution can make their evidence state anything they want. That exact quote comes from an attorney that I know personally. Evidence can always be made to say whatever you want in a court case.

So the reality is prosecution they lay out their burden of proof or their quote unquote evidence, another defense have to be able to prove that the prosecution is wrong. OK technically they don’t prove anything they just have to put calls in the other side story. But I say tomato tomatoe. At the end of the day it’s basically the same thing. The doctor is basically going to have to demonstrate why they did what they did. And because there are not clear set rules and clear set guidelines, the end result is a lot of doctors won’t do it.

    FishInABarrel ,

There is a such a thing as an affirmative defense, though. An affirmative defense allows a person to commit an act that would otherwise be illegal under certain circumstances. However, as the name implies, an affirmative defense has to be argued by the defense. The burden is on the defense to prove that they acted under the circumstances permitted.

Consider murder, for instance. Self-defense is usually an affirmative defense. The prosecutor's only burden is to prove that you killed someone. You have to demonstrate that you were acting in self defense in order to avoid the guilty verdict for murder.

So @vettnerk is asking a good question: will it be assumed that the doctor acted in good faith, or bad faith? Does the defense have to justify the abortion, or does the prosecutor have to demonstrate that it wasn't necessary?

    Chetzemoka ,

And it's not just the doctors. Hospitals are businesses that are not interested in taking on financial and legal risk. Even if a doctor is willing, they won't be able to, if they don't have a hospital facility that will allow it

    HuddaBudda ,

    SulaymanF ,

The current Texas law puts the burden on doctors; they have to PROVE that an abortion to save life of the mother was the ONLY option. Doctors do not want to risk jail time and a trial over this, so many necessary abortions were held back, endangering the mother. The court notes this which is why the ruling was issued. Texas AG is denying this reality and claiming the women are being hysterical.

Account less than an hour old. Made to "troll", im sure.
    Very "original".

    Also got banned, nice.

    Hyperreality ,

    Such a lazy troll too.

Back in the day, a troll would manipulate people into embarassing themselves or getting into arguements, then walk away from the shitshow they'd caused.

These 'trolls' do the equivalent of shit in their pants for attention.

It’s such a shame. Good trolls are slow burns, and most most importantly they’re not personally invested in the topic. Honestly I compare it to comedy. A comic is on stage and points out something about a topic that on its face is comedic but then you stop and think and realize the absurdity of it and that absurdity is why it’s comedic in the first place. A good troll is one that starts an argument between people who share beliefs and it should develop in such a way that people can take a step back and realize the absurdity of what they’re arguing about. It should result in growth for all the parties and observers involved to realize that they’re arguing over stupid meaningless stuff and that there are bigger problems than whatever they’ve spent who knows how long bickering about.

But it’s just developed into snatching low hanging fruit and simply getting a rise out of people by simply saying slurs or bigoted comments.

This is the textbook play. If you can’t obfuscate that it happened, you brazenly embrace it as though there is nothing wrong with it.

But that doesn’t work in court, only in the media.

    ChrisLicht ,

It’s pretty obvious that he’s playing for either nullification or a political solution.

And, chances are good that he’ll get one.

    Starbuck ,

He doesn’t care what happens in court because unless he is sentenced before he takes office, he doesn’t even have to figure out if he can pardon himself. And in that sense, more is not better. 3 (or 4) strong cases against him on Jan 20th doesn’t matter because he can just tell his AG to keep firing people until this goes away.

He doesn’t have to win in court, he has to to win the election.

    Mirshe ,

He may only need to win the nomination. I could see his lawyers arguing that “you can’t disrupt an election by convicting one of the candidates”.

    Neve8028 ,

He really does know the best people.

All the best people probably told him he has no case so he found some incompetent whackos who will argue whatever he wants them to.
