In short it’s typically limited to when judges make things up whole cloth, like qualified immunity, without legal basis. In judicial circles striking down laws or saying a law isn’t applicable in a certain circumstance typically isn’t regarded as legislating as they are ruling on the justness and applicability of an existing law rather than creating something wholely new.
The guy that got arrested says the president asked him to do it to raise the president’s popularity. Does seem a little suspicious to try a coup with almost zero support, and then just roll over when the president says to stand down.
That makes no sense. Why would the military guy go along with that plan, and then after being caught as planned he then suddenly tells the world about the plan?
My boss was talking about wanting them all investigated for sex crimes. Just like… How is that a good use of tax money? More funny is the fact that he doesn’t believe taxation should be a thing…

They also skipped the part where this was apparently caused by the general saying mean things in a paper about the president, getting fired, then coming back with tanks to hash things out.
All in all, I’m glad this was over quickly with only damaged palace doors and walls and not death and destruction of Bolivian people.
I don’t think this would help them in this case. The current president was part of the Morales administration and is a member of the Movement for Socialism. Neither of those are very close with the US.
