The big threat of that would be a dismissal after a jury was sworn. At that point, jeopardy attached, so rebringing the case could be unconditional under the double jeopardy clause [0].
The virtually unappealable way to do this would be to wait until the prosecution finishes their case. At that point, the defense will file a routine motion for a directed verdict that judges routinely deny. The defense gets to do that again after presenting their case. In either case, the judge granting the motion is not apealable.
The judge could wait until after a verdict and issue a judgement not withstanding verdict, but that is appealable.
[0] Not always though. A mistrial from a hung Jury can always be retired. Other forms of mistrial may be retryable depending on the facts.
What democracy? It’s a two-party, two-opinion system that’s completely broken at the verge of civil war. The US is the least democratic country of all democracies.

It absolutely is not sustainable, that’s true. Something’s gotta give. We have fundamentally different, diametrically opposed visions for what we want America to be. That has to be resolved, one way or another. Either one vision wins out over the other, we try to find a compromise between the two visions, or we break apart and go our separate ways. The way I see it, those are our options. Unless there’s some other option I’m not seeing?

The goal was to reduce the power of the federal government, now everyone is on board with that. Now businesses only have to deal with state regulations instead of federal, and states are much easier to control/fight. All of this culture war crap was just a way to get people to fight for deregulation.
