Salamendacious OP ,
@Salamendacious@lemmy.world avatar

Who knows maybe by adding 6 months it puts her in a different category for parole or something. It only takes $1 to move you from one tax bracket to another one. Maybe something like that is involved. I honestly don’t know.

mememuseum ,

That’s not how tax brackets work. If you were one dollar over the next tax bracket, only that dollar would be taxed at that amount.

Salamendacious OP ,
@Salamendacious@lemmy.world avatar

You’re right I was just trying to illustrate something and I thought that was a good enough example but you’re absolutely correct

kraftpudding ,

I think you might have a misunderstanding about how tax brackets work (at least if you’re taking about american federal income taxes). Progressive tax rates mean that only the income that is over the threshold for the new tax bracket gets taxes with the higher %. So if you are $1 over the limlt for a new tax bracket, only that dollar gets taxed with the higher percentage. You can read about this anywhere, this is just the first source I found.

So, I don’t see how this example still applies here. But after some reading, apparently the prosecution got some new information after the plea deal, so the asked for 9 years, and the judge compromised on 8.5. That’s at least what this article implies.

Pazienza’s plea agreement called for an eight-year sentence but prosecutors asked for nine years based on new information contained in a presentence report, a spokesperson for Manhattan District Attorney Alvin Bragg said.

Shush ,

I am 32. I love my dad, he did his best. He was a good dad.

But I will probably never be able to forgive him for the times he shouted and yelled at me when I wasn’t a good kid. He went into fits of rage over mundane things like homework and failing school. I remember everything he said in those fits of rage. Every instance of it. And I definitely remember feeling terrified.

And will remember it until the day I die.

Even at 70 years old.

Raine_Wolf ,

This makes me sad tbh. I’m 21, and get flashbacks of my dad yelling at me, especially when someone yells at me irl. I was scared that I’d spend my life trying to get rid of them… now I wonder if that’s even possible

Shush ,

You might be able to do it if you’ll get closure by talking to your dad about it.

My dad is the type that is never wrong, never does anything bad, and therefore never apologizes. I brought this up a few times and he always say I exagerrate or those instances never happened. He will never own up to it.

Raine_Wolf ,

Unfortunately, both my parents are like that too. I went no contact for that reason, actually.

angrystego ,

It is possible to get closure anyway, eg. by not doing the same mistake yourself or by surrouding yourself with healthy relationships and realizing your parent is just a human being full of faults and you’re your own person. I have examples around me of people who were able to get over it finally and also of people who carried it with them their whole life (and I don’t blame them). The sad thing is how many people have such burden in the first place.

wheres_my_pinata , in How a Big Pharma Company Stalled a Potentially Lifesaving Vaccine in Pursuit of Bigger Profits

I find it odd that the author did not really talk about the insurance companies at all. In the US, big pharma tends to make sure the payers (insurance companies) will actually cover a drug before they spend the money to bring it over the finish line. The payers look to maximize their revenue too, which means they are more interested in treatments that will (1) keep subscribers alive and paying into the system for the longest while (2) also reducing bigger more expensive health care costs down the road. Basically means that preventive treatments for younger people with private insurance get the priority. Pharma doesn’t decide their research priorities in a vacuum.

Eccentric ,

The point is that a TB vaccine wouldn’t be administered much in the US, but mostly to people in extreme poverty in South Africa and Eastern Europe. The article says that the organizations most likely to buy the vaccine would be local governments and non-profits, which can afford to pay a much lower price than insurance companies in the US. That’s why a TB vaccine is a lower priority than shingles, because the market for a TB vaccine would be people living in extreme poverty in developing countries, while shingles is mostly a concern for affluent people with insurance in the US, even though a TB vaccine would save many more lives.

wheres_my_pinata ,

I should have been more clear. I totally get, and agree, with your point. And I realize that my topic was implied in the article because of that point. I was just disappointed the author didn’t explicitly call out the payers too. The whole system is broken, it’s not just the pharma companies. I think it’s important to shine a light on the entire ecosystem if we’re ever going to have a prayer of combatting it.

Eccentric ,

Sorry if I came off as patronizing. You’re right, that’s definitely a problem and it’s a shame life saving treatments can’t get made because they’re less profitable than gaming our broken system

SCB , in Tulsa mom pleads guilty to allowing 12-year-old daughter to get pregnant by grown man

Everyone in this case is just stupid, and stupid people aren’t a threat to society, and putting these people in prison hurts the already-traumatized girl even further. She should be removed from the home and both adults should be liable for child support while also under a no-contact order until the child is 18 and can decide to continue it or not.

This probably doesn’t need to be said but Oklahoma is a shitty hellscape.

lolcatnip ,

Sure, let’s just ignore all the rape because the defendants are stupid.

SCB ,

As you can see by reading my post, I did not ignore the sexual assault.

However, no one gains from these people being imprisoned and people who want others “punished” should not be in the room when adult decisions are being made.

A vengeance-based prison system is immoral to the point of being evil, and a sign of barbarism in the person advocating for it.

agent_flounder ,
@agent_flounder@lemmy.one avatar

Once again for the folks in the back…

A vengeance-based prison system is immoral to the point of being evil, and a sign of barbarism in the person advocating for it.

Without rehabilitation and lower recidivism it only makes things worse not better for society. More and better rehabilitation programs are needed. And we need to do a far, far better job of addressing poverty and child abuse.

Also, privatized prisons stand in the way of achieving the greater good here. Sort of like privatized healthcare and health insurance.

tryptaminev ,

In this case we do gain, because less stupid people will otherwise go scotts free with playing stupid.

The law must consider intent to a certain degree, but it cannot be bent all the way if someone is considered too stupid to think about his own behaviour as problematic.

SCB ,

If we’re putting stupid people in prison for being stupid, were going to need a LOT more prisons.

ickplant ,
@ickplant@lemmy.world avatar

You totally ignored the sexual assault. You said it’s just “stupidity.” Raping an 11-year old girl is a lot more than stupidity. They all need to go to prison.

SCB ,

My comment is pretty short and this should not be difficult to parse. I never forgot nor justified the sexual assault.

My other point is that your personal feelings here

A) are objectively wrong

B) are evil

AWistfulNihilist ,

I wouldn’t say you justified, buuuuuuut, you are literally reducing the punishment of the adults because of some perceived additional damage to the abused child. Which almost totally removes the accountability for the act, the only accountability in this case is separation, which would need to be done either way.

I would say this girl has been so unprotected by her guardians and the rest of the family that separation will be a net positive for her in the future.

You’re characterization of the other person’s totally normal opinion as evil tells me everything I need to know about you tho.

SCB ,

literally reducing the punishment of the adults

Yes. Punishment is meaningless in the current prison system and has no reason to exist other than to slake the bloodthirst of the populace.

If someone is not an imminent threat to others they should not be imprisoned.

AWistfulNihilist ,

The dude who was in the relationship to the 12 year old and either didn’t realize his impact or didn’t care, as well as the mother you mean? I would argue they continue to pose a real danger to the daughter, and that man committed an egregious act of abuse on a child who was at worse coerced and at best a victim of a much older person.

I have no trust he won’t engage in this same behavior again. Unless you think it was just an exceptional 12 year old? Like have you met any 12 year olds so wise and beautiful you forgot about the fact they were 12 and just wanted to fuck a baby into them?

Although I totally agree that the prison system in the US is a sort of torture/slave labor system and many of the people engaged in that system are due to circumstances rather than “crime”.

Absolutely not the case here, this is a pretty easy call to make imo!

SCB ,

This would be why I suggested they not be allowed to contact said daughter

AWistfulNihilist ,

So let the dude prey on other children? Or spend resources on closely monitoring him for however long his parole is, same with the mom. But as you noted, these “stupid” people are a continuing risk, right? I don’t know, maybe this is the appropriate use of prison, I do wish there were education and rehabilitation programs that weren’t gutted, but in this case prison solves so many problems for the victim!

SCB ,

Per the article, he was in a “genuine” (I mean, obviously not but still) relationship with the child, after breaking up with the mom.

I don’t see this scenario repeating. Both the adults need serious therapy and obviously the kid does now too.

AWistfulNihilist ,

I just want you imagine the type of person who would get into a genuine relationship with a 12 year old. You don’t see it happening again?

I think this child predator would try to get in another “genuine relationship” with another child, frankly.

SCB ,

I find that extremely unlikely given the circumstances of the first “relationship”

This story is fucking bonkers.

AWistfulNihilist ,

I think that’s actually the crux of our disagreement and I don’t think we’ll come together on it.

I think the fact that he ever engaged in any sort of romantic relationship with a 12 year old makes him more likely to do it again, he’s the kind of person who would get into a relationship with a 12 year old as a 24 year old.

I believe you are taking the face value indication from the word “genuine relationship” and not really interrogating the “with a 12 year old” part. I don’t think anything I say is gonna change that, and I don’t think your opinion is exactly gonna win over hearts and minds on my end, so I guess I’ll end it there!

SCB ,

Oh don’t get me wrong, this person needs severe therapy. I just think therapy and productivity for a child he should never be allowed to see (2 children , honestly) is a better outcome for the victim.

eatthecake ,

People have a right to defend themselves. If society refuses to protect us by locking up criminals then you better loosen self defence laws A LOT and prepare for violence.

SCB ,

Best of luck man.

lolcatnip ,

I’m all for abolishing the vengeance-based system we have, but deterrence is a thing. So is keeping dangerous people away from potential victims. Obviously it only works to a point, and some people won’t be deterred no matter what, so unreasonably harsh penalties don’t help, but if people are allowed to rape children right out in the open with no consequences, more people are definitely gonna do it, because wanting to rape children is such a common thing there’s a whole political party that wants to make it legal (and has succeeded in many cases).

SCB ,

Hey thanks for at least not assuming I’m a pedophile because I have issues with the criminal justice system

I’m sure there’s a middle ground here wed find mutually acceptable

lolcatnip ,

Ugh, people who do that are the worst.

DogMuffins ,

We imprison rapists to ensure they do not harm others.

SCB ,

Violent rapists are indeed some of the few people I do support prison (with heavy reforms) for. They tend to have crazy high recidivism rates and need rehabilitation before release.

kofe ,

Honestly 95+% of rapists go free, so I lean toward restorative justice models, too, personally. Gotta destigmatize offenders getting help while taking accountability and helping victims. I say this as a victim of rape btw, and sexual assault, and harassment and distribution of sexual material without my consent. Prisons aren’t a viable solution.
