FireTower , in The Supreme Court rules that state officials can engage in a little corruption, as a treat
@FireTower@lemmy.world avatar

Posted this in another thread on the issue but worth saying again because most people see to be confused as to the actual implications of this ruling:

Although a gratuity or reward offered and accepted by a state or local official after the official act may be unethical or illegal under other federal, state, or local laws, the gratuity does not violate §666.

Tldr the ruling only was about in relation to one law. The party may be guilty of a form of corruption under a different law.

www.supremecourt.gov/opinions/…/23-108_8n5a.pdf

Read page 2 of the syllabus where it says “Held:” until page 4 if you want the shorter version.

Otherwise there’s a 16 page explanation under the “opinion of the court” section directly after the syllabus, for those who are interested in a longer explanation.

TLDR of the TLDR:

Court said the gov charged him with the wrong thing. Look for another charge, he’s probably screwed.

Maggoty , (edited )

Except SCOTUS will just strike down the next one too. The modern court has never supported bribery charges that come before it.

Edit to add a quick history from the last 25 years.

Sun Diamond Growers - The government must prove the bribe is actually connected to the act.

Skilling - Corruption charges require a second party to give you a bribe or kickback, self dealing is fine.

Citizens United - Money is political speech, and you can spend as much as you want on an election.

McDonnell - Acting as a pay to play gatekeeper is fine. Even if the government connects the bribe to the act.

Ted Cruz - Politicians can keep unspent campaign funds as long as they maintain the fiction of having lent the campaign money.

Snyder - Kickbacks aren’t actionable. <- We are here.

For years this demographic crisis has been coming (it was taught in schools in my country over 20 years ago!), yet we still harp on about overpopulation.

Population collapse is coming if this doesn’t change.

Etc.

No and none.

He just walked out of a US district court. If they were going to grab him they would have.

He rolled the dice on being the world’s most well known “journalist” and he lost in the most spectacular way. He’s so incredibly lucky he got off as lightly as he did, having only lost 12 years of his life.

Yes I think this has broken him. Quiet life in the burbs with the occasional phone interview on someone’s podcast.

tal , in Minnesota GOP Candidate Accused of Throwing Tarantula at Alleged ‘Squatter’
@tal@lemmy.today avatar

I don’t really care that much about tarantulas, but IIRC from some videos on tarantula-handling, tarantulas are big and heavy enough that unlike some smaller spiders which have a terminal velocity that isn’t going to hurt then – they can fall as far as they want – tarantulas can’t really handle being dropped very well. So throwing a tarantula probably is kind of a dick move from the tarantula’s standpoint.

kagis

spidersplanet.com/what-happens-if-you-drop-a-tara…

Unfortunately, dropping a tarantula poses serious risks to the spider, with potential consequences influenced by factors such as fall height, landing surface, tarantula species, and the spider’s health and age.

The higher the fall, the greater the impact force, making even a small drop potentially fatal.

A solid landing surface, like concrete, increases the likelihood of severe injuries compared to softer surfaces.

Different tarantula species exhibit varying affecting levels and their ability to survive a fall. Young or molting tarantulas with soft exoskeletons are more vulnerable.

If a big tarantula falls, it can go really fast, and its belly might break open, causing internal damage and, in the worst case, death.

That is why heavier spiders usually stay on the ground, while lighter ones prefer living in trees to avoid serious injuries from falls.

Potential consequences of dropping a tarantula include:

Abdominal Rupture: The gravest consequence, often resulting in fatality. The tarantula’s soft abdomen houses its internal organs, and a rupture can lead to organ spillage and death.

Internal Injuries: Even without abdominal rupture, the tarantula may experience internal injuries, such as bleeding or organ damage due to the impact.

Broken Limbs: The fragile legs of a tarantula can easily break upon landing on a hard surface.

And that’s aside from what a (large, powerful) human who suddenly gets a large spider thrown at them is likely to do to the spider in instinctual self-defense.

Tarantulas aren’t native to Minnesota, so this was probably someone’s pet. I don’t have a lot of affection for large spiders, but to someone, that was probably kind of like a dog or cat.

UndercoverUlrikHD ,

Yup, owner of a 11 year old tarantula at this point. Their blood also doesn’t clot so your best bet in the case of an injury is super glue and prayers to whatever entity you prefer. It’s one of two reasons why I don’t like handling her, they’re more fragile than you think.

Masks are not just for covid. Many people around the World wear masks when they feel ill for other reasons, and they also use them to counter bad air quality.
America is pro-sickness. Having a healthy nation, and actual National Healthcare is almost illegal in the USA, not yet, but close.
Republicans just want to control society and make money off of sick people.

mecfs ,

Not to mention, for disabled people like me with specific illnesses including long covid, this basically means we can’t leave our homes without severe risk to our health. In essence, another ableist tactic to hide disability.

fireweed ,

Yeah I kinda suspect these anti-mask laws are going to be a disability lawsuit bonanza

Republicans are doing everything possible to deny long covid is a thing. They are pushing the NIH to only fund research trying to (wrongly) make it seem like a mental disorder.
