Boy, for a state which prides itself for its self-reliance and independence, Texas sure does depend upon the federal government and its neighboring states a lot.

UnderpantsWeevil ,
@UnderpantsWeevil@lemmy.world avatar

This is more a “the cruelty is the point” situation. Dividing up families, keeping prisoners out of reach of their lawyers, and ferreting away anyone who might implicate the state in liability for criminal abuse is what’s driving a lot of this.

The goal is to convince people to “self-deport” rather than endure a Kafka-esque legal state.

RotatingParts , in Disney wants a wrongful death lawsuit thrown out because the plaintiff had Disney+

I don’t understand how arbitration ever came to be. It completely bypass the court systems, the very court systems that are put in place exactly for the purpose of making these type of decisions.

Voytrekk OP ,
@Voytrekk@lemmy.world avatar

It’s meant for B2B lawsuits, so they can both avoid extra litigation costs. They forced it onto consumers because they wanted to win more. They get to choose their arbitrator and avoid more public cases.

There has been some push back in recent years. This article by Consumer Reports shows some ways as to how people have been fighting back.

ceenote ,

It makes sense to have the option, but this trend of signing away your rights in the fine print should be outlawed.

dual_sport_dork ,
@dual_sport_dork@lemmy.world avatar

Especially if you didn’t sign anything.

Some consumer products are showing up with arbitration notices on the packaging now, and they count opening the box as “accepting” the agreement.

henfredemars ,

It’s a perversion of justice because of how its used to oppress people, that’s for sure. The last two places I rented had mandatory binding arbitration by an entity of the Landlord’s choosing, and in practice that means you’re completely at the legal mercy and whim of someone else.

It might as well read that I agree to sign away all my rights, and yet, people need a place to live. What choice do we have?

FlowVoid , (edited )

It doesn’t completely bypass the courts. Arbitrators don’t have the authority to enforce anything by themselves.

After both sides present their case, an arbitrator will write an opinion. That opinion must still be sent to an actual judge who checks it for errors and who has to take responsibility for enforcing it. Though it’s rare, judges have on occasion thrown out the arbitrator’s opinion.

Blackbeard , in Homeowners are increasingly re-wilding their homes with native plants, experts say
@Blackbeard@lemmy.world avatar

I’m one of them. Been converting entire chunks of an otherwise bland, uninteresting lawn to pollinator friendly patches. We have a certified milkweed garden for monarchs, entire sections full of drought-tolerant native plants, and rabbits have started living underneath the “canopy” of the flowering shrubs. The half of our lawn that’s still grass is easily 10x the maintenance burden that our gardens are, and we’ve already developed a plan to phase out our front lawn entirely. Some of the grass in the back is good for picnics and dog play, but we’re going to get rid of anything that’s not actually used. Only problem is most of it’s bermuda, which is a fucking PAIN to get rid of by hand.

Naich ,
@Naich@lemmings.world avatar

You are doing good work. Well done.

FourThirteen ,

Do you mind sharing pictures of what this looks like?

Blackbeard ,
@Blackbeard@lemmy.world avatar

How it started when we first dug up the grass, and how it’s going. We didn’t realize butterfly bushes were bad when we first started, so we’re killing them off one-by-one. The first dead one is in the background (tall bare twigs), and the dwarf BB is keeping our nectar supply up while most of the other plants have stopped flowering for the summer. It’s still very much a work in progress, but it’s starting to stabilize with some of the plants being more resilient than others.

FourThirteen ,

That’s really freaking cool! Thanks for sharing! What was the work effort for this amount of progress? I’d like to do this with my next house.

Blackbeard ,
@Blackbeard@lemmy.world avatar

Been focusing on this and another small patch for about 2 years. The up front work was a bear, just to get rid of the grass down to the root (those fuckers are DEEP) and get all the plants established during the right seasons. I’ve also installed a drip irrigation system that can compensate for some of our really dry periods during summer, which took a full weekend. Once the plants are in and mulch is down, really the only maintenance is keeping bermuda and sedge from popping back up. The first year required extensive weeding every month or two, but the second year has required very little because most of the soil is totally shaded out. It kinda supports itself now. My only problem at this stage is that the liriope border was pre-existing, so bermuda still spills out from existing root stock from that area, which means I have to more aggressively weed/trim that border. I benefit from the walkway being a natural barrier for encroachment from the rest of the lawn, but it’ll still take another year or two before the bermuda is totally neutralized.

cevn ,

What kinda shrub is housing the rabbits?

Blackbeard ,
@Blackbeard@lemmy.world avatar

They like to live under the asters and salvias, which form thick blankets of cover, and in little rows they’ve carved out between the liriope plants.

cevn ,

Awesome, might follow suit! Although they will go to town on my veggies lol.

TranscendentalEmpire ,

Only problem is most of it’s bermuda, which is a fucking PAIN to get rid of by hand

Get yourself an Action Hoe, you basically run it back and forth and it digs/cuts the roots out. It’s very upsetting how easy it makes weeding the first time you use it, turns an hour long job to something you can do in 15 min.

dmtalon , in Scientists find humans age dramatically in two bursts – at 44, then 60

Interestingly enough, a random couple things happened when I was between 43-44 that lead to me start distance running and run my first full marathon about 4 months before I turned 44.

I was decently fit before, but didn’t run any distance above a maybe 5 miles. I do not remember anything negative happening around that time or shortly after. I was actually increasing my cardio endurance dramatically over the next 5 years or so.

fpslem OP ,

Good on you, I’ve read elsewhere that the better shape you can be in prior to years of decline, the better you handle the natural aging process. I don’t need to do anymore marathons, they’re too hard on my knees, but running/biking and body-weight exercises are part of my attempt to stave off the inevitable.

dmtalon , (edited )

Oh ya… Marathons have come and gone for me :) Initially because they were just expensive but COVID had me WFH full time and the group I ran with was near my work office. So I sort of morphed into running alone and just as maintenance vs. Training for something.

I’m about to hit 53 and try to run between 15-20/miles a week still but I did fall behind on my fitness the end of last year when I had some crazy back spasms after sneezing (of all things) that really set me back. Takes forever to get back. Luckily I do not have any physical issues (knees etc) most if my issues now are not eating healthy enough and general motivation to improve. Sounds like I’ve got about 7 years to get on top of it so I can cruise through that age too :)

fpslem OP ,

back spasms after sneezing (of all things)

This is the true humiliation of getting older. In my 20s I climbed mountains and had plenty of scrapes and mishaps, but I just shook them off and my body just healed up quickly. Now I can tweak my back with a sneeze or be sore for days just by raking leaves. Life comes at you fast.

dmtalon ,

I literally could not get off the floor for around 2h and was panicking quite a bit. Never ever felt so vulnerable before. Do not recommend whatever happened to me :). Good thing is it was just muscle and once healed I was back to 100% It just prevented me from running for over a month.

Bishma , (edited )
@Bishma@discuss.tchncs.de avatar

This article is reminding me of a study a few years back that suggested that (provided you’re otherwise healthy and able bodied) you can get into any level or shape you want (if you put in the work of course) up until 60-something. Then you hit an age wall where about the best you can do is maintain what you’ve got. Suggesting that countering that 40-something aging event by pre-gaming for the 60-something aging is a smart plan.

dmtalon ,

So, I need to get motivated for the next 7 years :)

AA5B ,

Shor, ive been saying “I need to get into shape” for over a half century, but now i have only a couple years to actually do it? Now that I can’t sleep, ache everywhere, and have bad knees?

Bishma ,
@Bishma@discuss.tchncs.de avatar

I’m not impressed by how my meat mech is deteriorating with time given how much constant maintenance it requires.

AA5B ,

I mean, it’s just like a car though. When you first get one, you can rev it as much as you like, fly over speed bumps and potholes, miss an oil change, and no big deal. However that abuse all comes due at once, when suddenly so many parts are obviously degraded. At that point you may decide to replace your car …. I’m ready to replace my meat mech

DefiantBidet , in Scientists find humans age dramatically in two bursts – at 44, then 60

48 here… i used to be able to read the freaking copyright date on those eye charts … once i hit mid 40s i need glasses.

FlyingSquid ,
@FlyingSquid@lemmy.world avatar

I just got progressive bifocals. It was nice to be able to read my watch properly again, but not so nice to have to look down whenever I’m going up or down stairs and to have to move my head around all the time to see all the real estate on my monitor since it’s 27".

Duranie ,

I’ve worn contacts for almost 40 years, but got tired of using readers these last several years to be able to, you know, read. After unsuccessfully trying multivocal contacts, I got progressive glasses. My vision? GREAT? The 3 weeks it took to get my brain used to moving my head more and my eyes just right (especially while driving) so that seeing the right part of my prescription wasn’t swinging all over the place and making me nauseous? Fucking hell. That was absolute torture. It’s worth it on the other side at least.

I do kinda miss contacts. I may get a second opinion for my prescription and try again.

Bishma ,
@Bishma@discuss.tchncs.de avatar
