dojan , in Biden signs historic order moving prosecution of military sexual assault outside chain of command |
@dojan@lemmy.world avatar

It was in the chain of command before? Wow gee I wonder how that could possibly go wrong!

Why the fuck are these cases even handled by the military and not the regular criminal and civil courts?

    Redditgee ,

Playing advocate, but that’s why UCMJ exists, at all. They should prosecute all crimes under UCMJ, or none. It doesn’t make much sense to only do certain crimes under civilian courts.

    RGB3x3 ,

The UCMJ is also harsher than civilian courts when prosecuted appropriately. It has specific statues related to military-type crimes like duty abandonment and not following orders.

You don’t want to go to military jail, that’s for sure.

    I_Fart_Glitter ,

I mean, if UCMJ doesn’t consider prosecuting rape to be worth their time, it’s good that they’ve been relieved of that duty. Solders endure enough trauma, getting raped by those they serve with and under shouldn’t be par for the course.

    galloog1 ,

The civilian justice system is absolutely not better at executing justice and is arguably worse on many ways when comparing similar cases. At least the rape kits get actually tested and processed in the military.

    Huxleywaswrite , (edited )

I wonder if you realize you’re commenting on a reply of someone telling a story about how one wasnt even investigated and then the rapist was promoted after doing it again.

There’s plenty to criticize in our civilian justice system, but that doesn’t mean there isn’t plenty to criticize in our military justice system. This is one of those things, the military is notoriously bad at handling sexual assault cases.

    galloog1 ,

I was commenting on if it is worth their time. I find it to be a wholely unjustified statement given the fact that they actually conduct justice unlike civilian juridictions. If it wasn’t worth their time, they wouldn’t be addressing it.

    Huxleywaswrite ,

So you’ve already made up your mind and don’t care what facts and testimony is presented to you?

I hope you see the fucking irony in that.

    galloog1 ,

I addressed specific points. You have leveled an accusation without addressing my point. What are you expecting in response?

I have had this command authority before. I’m not going to sit here and tell you that ucmj is perfect but it’s the best we can do and it is better than the civilian sector. That should end the conversation right there. Your comments are like the pot calling the kettle black. If you have a better suggestion, why has it not been implemented yet literally anywhere?

Complaining about the way things are without a suggestion is worse than unhelpful because it increases discontent which leads to more conflict.

Thinking you know better than literal experts speaks for itself. I hope you see the irony in that.

    Huxleywaswrite ,

You didn’t address shit, you said ‘were better than theirs’ and left it at that.

Your word, from someone who sat in this corrupted chain of command, should be all I need to trust that you’re the best? That’s gonna be a hard fuck you from me.

Your attitude toward this is exactly why you shouldn’t have jurisdiction over it.

    galloog1 ,

I commented on if the accusations were worth the military’s time. It is apparently worth the military’s time more than the civilian justice system’s time.

    Statement -> rebuttal

You can take your ignorant self and go fuck yourself. You don’t even know how little you know about this issue yet you opine pretty strongly about opinions you THINK I have.

While I wholely support a civilian controlled military, your attitude towards this is why civilians make horrible military governance.

    Huxleywaswrite ,

I’m sorry I thought I’d already blocked your ignorant ass

    galloog1 ,

Right, don’t address my points. Just flip the table and walk away.

    snooggums ,
    @snooggums@kbin.social avatar

Supposedly to hold them to a higher standard, but like with police internal affairs it is just a way to deflect attention that would make the system look bad.

    StealthToad ,

Because the military has been fighting it for years. I remember having a SHARP class where the instructor was telling us that we didn’t want this, that civilians shouldn’t get involved in military matters and some other bullshit I can’t recall.

I was too young, dumb, and loyal to a fault to understand what was being said.

    PlantJam ,

    Just to spell it out:

Promotions are based on performance. After a few promotions, you have people that report to you. This means their performance is your performance. So the CoC properly handling rape allegations is against their own self interest.

There’s a documentary called the invisible war that covers this topic in excruciating detail.

    foggy ,

    Did I rape my subordinates?

    Let me check…

    Nope, I found no wrongdoing.

Here that, gang? Now stay in line.

    Can concur here.

My company, at first, decided to ask everyone to come back into the office.

They were also trying to hire more people, but almost every candidate dropped out once they heard they would be expected to go in.

They’ve now reversed course and let people work from anywhere.

partial_accumen , in We’re now finding out the damaging results of the mandated return to the office–and it’s worse than we thought

Unispace found that nearly half (42%) of companies with return-to-office mandates witnessed a higher level of employee attrition than they had anticipated.

One aspect these articles don’t usually address beyond the attrition rate, is the quality of those leave is usually the highest. So its a double whammy. Not only are you losing workers, you’re losing your best workers. Those best workers have mobility because they are in demand for their skills or ability to execute. So what an employer is left with is even worse, many of those remaining that are lower skilled or less ambitious so their can’t leave or choose not to because they aren’t interested in high achievement at work.

The company’s most valuable asset is their workers. Return-to-office is a loud screaming message to all the company’s workers that “butts in seats” or extraction of the worker’s dollars for corporate tax cuts from municipalities are more important that the worker’s comfort and preference. That leads to the death of companies.

I don’t often toot my own horn, but this is basically me. My work is pushing for people to move to LA into the office after being almost fully remote for a few years. I’ve never set foot in LA, and was hired fully remote. They’re struggling to hire junior devs because their frontend is almost wholly custom JavaScript and nearly completely undocumented. They’re currently stuck with expensive senior devs. I could easily take my title elsewhere for more than they’re paying me, but I like the lax work environment enough to stick around.

The last I heard about the move back to office was February, and they just hired more people out of state. I don’t think they’re pushing for it anymore, haha

    It was absolutely brutal!

    asdfasdfasdf ,

Not only that, but your best workers often help the others get better, as well as do code reviews, etc. which means the less good workers will also not be as good in the future, and you’ll spend more time fixing their mistakes.

    corsicanguppy ,

the quality of those [who] leave is usually the highest.

That’s the Dead Sea Effect. Those who can leave the easiest, do so next in each cycle (once the company crosses the fuckit line). These will be the most valuable.

While I dislike this model I understand it, in the past sometimes you needed to pay more for that brand new stereo or AC. What I find it annoying is that you bought the car with the upgrades already on it, just need to open the paywall.

And at the end of the day they won’t put it from their pocket, or you already paid for them or the people that bought the upgrades are financing the unused ones from others.

    admiralteal ,

It really fucks with the resale market, too. As is the intention. People will be getting used cars and being told they need to pay full, new price to unlock features.

More reasons to want right to repair and adversarial interoperability. So that if Tesla refuses to reasonable implement features that the hardware fully supports, a third-party can do it instead.
