Victim still got charged with a felony after spending 5 months incarcerated waiting for trial, and has to wait another month in jail to find out if the judge will overturn his final charge.

This case is exactly why DA’s level stack multiple felonies in these cases.

You know that his life wasn’t in danger because you know it was a prank. The defender here did not have the benefit of that knowledge.

When someone nearly a foot taller with 50 more pounds of muscle gets in your face and starts accusing you of thinking about their private parts, then you get to decide if self-defense is necessary. The defender tried to get away from the aggressor multiple times and told him to stop multiple times, but the aggressor obviously kept engaging.

Do you think he should have waited until the giant started punching or kicking him before he decided to draw his weapon? Should he have tried to punch the giant instead of using the weapon he has? Do you think you could outrun someone taller and in better shape than you are?

If the defender had multiple self-defense options he might have chosen another, but all of this is arm-chair quarterbacking. We weren’t there and the person that was chose the only real defense option they had.

This situation is entirely the Goon’s fault. He should be the one facing charges. While it might be reasonable to recommend a self-defense course for the victim, my understanding is that he already followed good self-defense principles.

Edit: Also, since no one else is saying it, I will. If the victim happened to have been gay, the aggressor probably would have been charged with a hate crime. The goon was clearly accusing him of it.

You don’t need to fear for your life just your safety. Those guys cornered him up against the counter and then followed him when he tried to get away, despite repeated requests to stop.

Even when he did fire, he didn’t unload the chamber at the aggressor and his friend, he fired a single round while continuing to try and leave. I think that is a reasonable stance, one I even mostly agree with. If any of the charges were misdemeanors, I might even have let that one through myself with time served and a request to take a firearm safety or self-defense course. However, I think the judge would still be having to decide whether to throw it out in a month.

However, once you say the self-defense is justified, trying to tack on additional charges is pretty unfair to the defendant. If he had another method of self-defense with him, he might have used it, but he only had the firearm and he used the minimum amount of force possible with that tool.

As I said below:

Disarmed lol. It is comically easy to sneak a gun past the TSA. I don’t remember the specific numbers, but there was a test done, and something like 85% of the trials made it through with the weapon.

What matters in this case isn’t so much the fact of being unarmed, as it is the behavior of the victims and law enforcement who might feel empowered to act based on the belief that the trafficker is unarmed.

Traffickers presumably don’t actually want to end up in a shootout—they just want the perceived possibility to serve as a deterrent.

Tons of people are shit-scared of flying and are visibly anxious. Tons of people drug themselves with benzos before flying.

But regardless of those two points, when the victim is at the point where they would be in an airplane with their pimp, controller, whatever you want to call them, they’re likely going to be well under their thumb, or happy thinking about that wonderful American business opportunity as a secretary or whatever they think is on the other side of the flight.

Sometimes it doesn’t play out like that, but often it does.

Many times they don’t use commercial air flights like you suggest, they drive. That’s why there are apps that allow you to take a 360° view of your hotel/motel/hostel so they can match them up with known sexual abuse videos.

Yes, I work for a private jet company and the FAA has mandatory training we have to take and the gist of it is, if you see something suspicious; report it. It usually doesn’t end up like this, they usually just surveil the target to get more info from what I understand.

Im familiar with a CO in one of the more ‘humane’ prisons in the country. Recently transfered inmates who are trying to power pose to their new cell block often get told they can calm down there by the veteran inmates. The prison rewards good behavior enough that it’s created a shift in inmate culture, AND STILL, there is tons of things that more than most people would consider much less than humane. This is another one of those deeply systematic problems that I guarantee you’ll find shades of in your own community.

I love that the judge gets to sentence him after this stunt. It’ll be hard for the judge to maintain a straight face when this asshole inevitably reads his prepared statement about remorse and personal responsibility.

I think the reason why US went with officials can still “serve” even dead is to avoid political killings (or to avoid a loophole in “justice system”, just like mitch mcconnell who is probably acting having a seizure on his live speeches to avoid heavy charges because he knows the fed knows he has a huge role with trump shenanigans annnnnd unfortunately, it is challenging to press charges against persons who has “mental” illness and stroke can be considered as one).
