StarServal , in A police raid of a Kansas newsroom raises alarms about violations of press freedom
@StarServal@kbin.social avatar

Local authorities said they were investigating the newsroom for "identity theft," according to the warrant. The raid was linked to alleged violations of a local restaurant owner's privacy, when journalists obtained information about her driving record.

Oberlander said exceptions to the Privacy Protection Act are "important but very limited." One such exception allows authorities to raid a newsroom if the journalists themselves are suspected to be involved in the crime at hand. In a statement sent to NPR, Marion Police Chief Gideon Cody cited this exception to justify his department's raid of the Marion County Record.

However

Several media law experts told NPR the raid appears to be a violation of federal law, which protects journalists from this type of action.

@introvrt2themax@sh.itjust.works avatar

A bit of cherry picking there

But Oberlander said that exception doesn’t apply when the alleged crime is connected to newsgathering — which appears to be the case in Marion.

Pandantic ,
@Pandantic@midwest.social avatar

Meyer, the Marion County Record’s publisher, said local restaurateur Kari Newell accused the paper of illegally obtaining drunk-driving records about her.

But the paper, Meyer said, received this information about Newell from a separate source, independently verified it on the Kansas Department of Revenue’s Division of Vehicles website — and decided not to publish it. The paper instead opted to notify local police.

Here’s their justification - they found out about a business owner’s drunk driving records, and told the police. The police decided this was “identity theft”.

MagicShel , (edited ) in Boy survives 100ft Grand Canyon fall after dodging tourist photo

Why does the headline say he was “dodging tourist photo” but there is nothing about that in the article. For some reason my brain wants an explanation of that. Was he trying to politely stay out of someone’s photo, or was he doing that thing where they don’t want evidence that they ever got to go anywhere nice or do anything fun or indeed were even members of the family?

Edit: nevermind, it’s there.

maaaaaaaadddd ,

It’s in the article…

Wyatt told a local television station he had fallen while moving out of the way so people could take pictures.

Hey, if he’s “lucky,” he can get disability!

I was on disability for two years. I got a grand total of $14,000 after it was determined that 60% of my ability to work would be affected by my (since mitigated) nerve disorder. Apparently being able to work at 40% capacity means I needed to get a job. I’m sure they would have loved me screaming in pain in whatever office.

Also, I got that $14,000 after the fact due to the legal system being so swamped.

Thanks, Republicans.

Wyatt had been at the Grand Canyon on trip with other members of his family, who told KPNX they intended to take a road trip home to replace the memories of the fall.

Ok, everyone! Wyatt broke his back and collapsed a lung. Who wants to see Disneyland?

    I looked at that source and most of thr US’s dings seem to he security. But note that the source says that basically no one gets arrested or killed by the government for being a journalist. Thus, I’m gonna say that it’s mostly our crazy populous, which with the climate after Trunp makes sense.

    The original point that the US has strong protections (by the government) for the the press stands. We just can’t do anything aboutnpur citizens.

    Meho_Nohome ,
    @Meho_Nohome@sh.itjust.works avatar

    This is just one story about it. Many journalists under the last 3 administrations have had raids and seizures of their devices. It’s an extremely disturbing development, but it actually dates back to the Wilson administration. It’s not nearly as new or as rare as it sounds.

    Auto correct is a bitch sometimes.

    NewNewAccount ,

    This is exactly why we need a free press and a non-corrupt government at all levels. It goes without saying, but an asshole sheriff shouldn’t be able to fuck with the nearby citizens without consequence.

    Meho_Nohome ,
    @Meho_Nohome@sh.itjust.works avatar

    A non-corrupt government, by nature, will never exist. That’s why the press needs to exist, until it also becomes corrupt. There seems to be no difference between the national press and the government in the US. I remember when I was a kid, I thought the press was part of the government. I kept seeing government officials going to work for the press and I just assumed it was one big organization. Now that I’ve gotten older and understand what’s going on, I realize that I understood more as a kid than I thought I did.

    The only way the sheriff will be reigned in is by the local citizenry. If they ignore it or accept it, then there’s nothing to to stop him.

    Burn_The_Right ,

    Why is this comment getting downvoted? Serious question. This comment describes the chilling effect upon the free press that this governmental abuse will have.

    The solution: Amnesty and citizenship. Screw this "Everyone must suffer trying to be here." They wanna be here. There are jobs for them. Just swear them in and forget all this bullshit.

    mcc ,

    I wouldn’t go as far as citizenship. Work visa, at least. And you know why that won’t happen. Stealing out jobs and all that.

    Ragnell ,
    @Ragnell@kbin.social avatar

    I would. Hell, just to punish the guys who are hiring below the minimum wage I would give them citizenship AND a union card.

    Buddahriffic ,

    Make them pay all the workers the difference between their actual wages and minimum wage up to a few years back and, once established that they do in fact work there, it’s up to the employer to prove they weren’t there that long but require full access to those books and include everyone in them for the back pay. Plus personal liability for anyone who was aware when it bankrupts the company.

    Edit: and the reporter is fast tracked through the citizenship process.

    Here’s a non-Fox link. BBC version of the same story.

    Hurts ,

    We encourage people to do this for Fox News links.

    While Fox News isn’t actively blacklisted at this time, our stance is that we do prefer other sources/outlets if the same story is available. As I mentioned in another comment, we read both of these articles and they contain basically the same content, so we left this post up, and that is basically how these posts are being evaluated at this time (checking to make sure they aren’t misleading/reporting incorrect information).

    Also as mentioned in my other comment, we do also understand that a lot of users do not want to click Fox News links and support them, so I do also encourage people to post links to other outlets in the comments so users can still read the article if they choose to do so.
