I was on a jury in Texas in 2019 and we were tasked with both.

First part: Based on the facts you have been presented, do you think defendant did X?

If yes

Second part: You have determined that defendant did X. Now determine the punishment

That second part was by far the more difficult of the two

Got_Bent ,

There’s kinda like a second trial where they have friends and family of the defendant and victim come and tell you what s great guy he is or how much they miss the victim etc.

Then the judge lays out the range of possible punishments, including when parole might be available. We’re not allowed to consider when parole might be available though.

Then we all go into the deliberation room and duke it out. When we were done, we go back into the court room and hand the judge the punishment which he then read as sentencing.

The punishment range given us was anything from two to ninety nine years or life, so basically, “do what you want you crazy jurors”.

Got_Bent ,

I know. The original post sounded pretty universal so I was giving an example of how some states do it differently.

Got_Bent ,

Huh. Argentina. Lots of his kind from the fatherland down there. And now he can’t join them.

When I was in college, I could fill up on three bean burritos at Taco Bell for $1.81 out the door. Del Taco was cheaper at $1.50.

That was thirty years ago, but still. I don’t know how to explain it, but it felt a whole lot easier to dig up that kind of pocket change back then than it does to dig up whatever it costs today.

Got_Bent ,

I had to Google this to make sure it was real.

Now is he gonna be like Bannon and ignore sentencing because there are no consequences for doing so?

Got_Bent ,

Did you have a nice… wake for them?

I’ve been rewatching quantum leap lately and it has me wondering what would happen if Sam failed to save the day. His missions were time sensitive, so once a given event would have passed without Sam fixing it, would he have been stuck in that place and time forever?

If so, would his lifespan be his age/body or that of the person he leaped into?

Got_Bent ,

I was thinking of this video as soon as I saw the post. She’s really an interesting person.

Got_Bent ,

I know nothing of this, but Israel backs both sides?

As a long time teacher of ESL back in the day, I’d say that depends heavily on the native language.

European languages generally do well

Asian languages generally struggle

Middle Eastern languages, well, things don’t translate well on paper

Conversely, I found the middle Eastern students to have excellent speaking abilities.

The difference in how the mind processes speaking vs writing was truly fascinating to me.

I had a long talk with my daughter about this last week.

I bought a small 700 square foot house about a year and a half ago. I’ll have it completely paid off in ten years.

My daughter made all the right moves and is making more money in her early twenties than she knows what to do with.

So here’s the plan:

When my house is paid off, she’ll have a house of her own.

I’ll retire and go live with her.

Then we rent out my house, but not in the traditional way. We’re going to look for somebody who is genuinely looking but unable to buy. We’ll go in the rent to own model, so eventually the tenant owns my house and the daughter has cash from the proceeds to go buy another house and rent it to own.

I’m sure somebody on lemmy will find reason to punch holes in this plan and call us horrible capitalist pigs, but short of outright giving everything away, this was the best we could come up with to use family assets for the good of others without starving ourselves.

Got_Bent ,

My visit to my daughter’s apartment did concern me in that I saw not one but two Scrabble sets on her shelf.

And she doesn’t have means to make coffee. That part will get immediately remedied.

But seriously, she and I are quite close. I was telling her that my biggest concern going forward is living alone and going full blown dementia as I failed in securing long term care.

I also told her to never, under any circumstances, sign anything remotely related to my healthcare because the fine print will make her assume financial responsibility. Fuck that. Dump my withering winkled ass in a storm drain before I let that happen.

Got_Bent ,

So I was you. I wasn’t financially stable until well into my forties. I would say I wasn’t raised by anybody. Forget about no parental money. I had no parental guidance, and from that I made a TON of beyond stupid decisions.

Fast forward, and I finally got my shit together. I was able to get my daughter through college without debt and her mother sold her a car for a reasonable price.

So now she’s in her early twenties making more money than I do, and she’s always concerned with mismanaging it. But being who she is, she’s also constantly worried that she’s not doing enough good for others.

Her first house will be with her own money, but I was fortunate enough to help her get into that position.

Just on principle, I’m hell bent on leaving an estate to her even if she won’t need it. From there, I just hope it further supplies her with the tools to realize her ultimate altruistic ambitions.

This being Lemmy, I’m sure something about this is wrong or evil or selfish. I can’t accommodate every random Internet criticism, so I do the best I can.

As to the daughter, I’m just so proud of her. Aside from the line of work, she’s artistic and empathetic and caring. You know, an exponentially better person than I could ever hope to be.

In my fifties and still have that dream, but it’s worse.

I went to boarding school, so my dreams involve fifty something year old me having to go back to live in the dorm with a bunch of kids.

First, the globe would have to be solid and sufficiently dense to scale.

Then, it would have to be removed from any other significant gravitational field - such as the actual earth.

Then, the layer of water would be as deep as about half the width of a pin.

Then yes, it would work and the water would settle on the globe correctly.

(I am not a scientist and have probably missed a variable or twenty in this summation)

Got_Bent ,

I did think about that, but I don’t know how surface tension works. I’ll certainly take mostly correct. Not bad for an amateur who just watches physics videos for fun.

Got_Bent OP ,

It’s rare that I fry anything but when you get a good French fry down, the oven or air fryer just doesn’t compare.

Got_Bent ,

My daughter came home from middle school once.

She plopped down in a chair, let out a sigh, and said, “Math is the only thing in the world that makes sense.”

I’m surprised I still have a tongue after biting down so hard to suppress the laughter.

Got_Bent ,

While it’s not the area I ended up working in, I learned in accounting school that the employees who never take vacation are held as highly suspicious. People who are in a position to skim off the top tend to never take days off so nobody gets opportunity to see what they’re doing.

As to me personally, I remember one year taking all the PTO that was due to me and getting shit on in writing at evaluation time for doing so.

The following year I took zero PTO and got shit on in writing at evaluation time for doing so.

I went to management with copies of both evaluations and said, “since you’re gonna shit on me in writing at evaluation time regardless of what I do, you can expect me to take every minute of PTO going forward.”

They were at a loss for words and just found other reasons to shit on me in writing at evaluation time.

I spent five and a half years in that environment.

Never again. Not for any amount of money.

Got_Bent ,

So when we switched over to the unlimited PTO scam, there was an option to get paid out for the PTO you had accrued. Naturally I was like two hours short of the threshold, so at the end of the year, around December fifth or so, I was like, “later bitches! See ya in January!” and there was nothing they could do about it. It was beautiful.

Got_Bent ,

Funny you mentioned that. I was out with my daughter a couple days ago and she got a flat that had to be replaced. She was legitimately worried that Toyota would void her warranty for not buying a tire from the dealership. Nevermind that we were out in rural nothingness with no Toyota dealership to be found.

Got_Bent ,

Why would you justify this insanity? Look at the clowns that they put on there — you don’t subject yourself to that nonsense," he said, evidently speaking of the jury.

Both sides had ample opportunity to vet potential jurors. Your side is just as responsible for its makeup as anybody.

Got_Bent ,

Both of those are way down from when I was in my twenties.

Got_Bent ,

The commenter above you was clearly not around in the eighties if they don’t think tobacco consumption has dropped. I’m amused that I’ve seen this argument at least twice in this thread.

Got_Bent ,

I love the hit counter. Super nostalgic right there.

Got_Bent ,

There’s pretty much zero oversight for a supreme court justice, right? I’m kinda surprised he didn’t just lynch a few brown and/or gay people in his front yard because doing so would have equal consequence - none.

Got_Bent ,

Tried, convicted, appealed all the way up to his own court, conviction overturned.

If Trump wins, this guy gets a pardon and a cabinet position

Got_Bent ,

Even today when my daughter is a self sufficient adult, whenever she calls for advice, the first thing I do is bring my mind back in time to when I was that age and remember what was going through my head when a similar situation to hers arose.

It’s not natural for me to do this. I have to make conscious effort. But it’s proven to give me better perspective and increases her level of trust with me.

Got_Bent ,

The last time I logged on to Facebook was this past fall because there was a death in our fairly tight knit group of high school classmates. It had been three or four years since I’d been in there.

So I went on and said my words.

While I was there, I didn’t really notice what was in my feed.

What I noticed was suddenly I was getting notification after notification that my posts from years and years ago were getting deleted because they didn’t fit whatever the current terms and conditions of use were.

This amused me.

So I left my words of dead classmate up for a week then sent my account silent again.

I can’t see Facebook or any social media being a place I ever hang out again, which is a little bit of a bummer because without any social media, IRL social activities all but come to an immediate and total halt.

Oh well. I’ll live.

Got_Bent OP ,

I think that might be an option with at least two of the three

Wisconsin has a big Hmong population, all of whom came to the US legally. Holy hell the things I’ve heard people say about them. As if they’re not even human. This sentiment doesn’t surprise me at all.

Got_Bent ,

This got me curious if one could buy land in some remote unicorporated area to avoid any tax jurisdictions, but it seems that there would at the very least be county level taxes.

Got_Bent ,

I swear the federal governments that killed off entire populations of native Americans and authorized the recapture of escaped slaves were less childish and vindictive than today’s GOP.

Got_Bent ,

Don’t underestimate the magic of presidential healthcare.

Nixon was the last president to die before his nineties.

If Trump were a regular person like the rest of us, he’d likely already be dead, but whatever voodoo those presidential doctors perform, I wouldn’t be surprised to see him zombie along for another twenty years.

Got_Bent ,

I, for one, would rather have milk from a bear.

Hey man, when the serial killing manifests itself just remember I’ll always make you a kick-ass bloody Mary and I’ll never ask you to play Scrabble.

I have a rock just like the one pictured. Generally found in riverbeds or beaches that haven’t turned it all into sand yet.

The only surviving adult MOVE member, Ramona Africa, refused to testify in court and was charged and convicted on charges of riot and conspiracy; she served seven years in prison.

Jesus Christ! No criminal charges against police so let’s imprison the sole surviving victim!

(She did get a handsome settlement years later, so there’s that but holy hell man)

Got_Bent ,

Does this mean I still can’t watch porn in Texas?

Got_Bent ,

I believe the standard counter to that is that if you can’t meet that standard then you either shouldn’t have employees or you shouldn’t have a business

I don’t know what a PSN account is, but I’m surprised you can get one in North Korea.
