Just because Apple lists it doesn’t prevent them from taking it down off the App Store; having it loaded from his own does.

Did you miss the part in the rules that still have Apple controlling what can be on and who can offer 3rd party stores? Apple still has final approval over everything basically. They complied with the verbiage of the law, but certainly not the intended spirit.
