Okay, so no, it’s not hacking. It doesn’t fall under hacking laws. It’s not illegal to sell hacking tools. Basically, everything you said is wrong.

In this case, it’s all about copyright and the DMCA, which made it illegal to break the copyright protection systems companies put in place or to make or distribute tools to break copyright protection systems.

Nintendo had a clear path to victory in this case, it wasn’t a new idea that needed to be tested in court.

The yuzu devs really fucked up by adding in decryption to it. Without that, the emulator was totally safe, and likely why nintendo didn’t try and do this years ago.

If you’re making an emulator, or anything dealing with copywritten work. Don’t add things that break the copyright protection, nintendo can come for you then. It’s that simple.

i read it as just a simple way of changing what mode the controller runs in, normally you have to select those different modes by holding down button combinations when enabling pairing mode. to me it looks like they just made those button combinations a switch. so it’s a switch, and only pairs to a single device.

I’m gonna just preface this by saying Nintendo suck and I don’t agree with what they are doing.

But it’s worth understanding what is happening here, nintendo isn’t just throwing random legalize against the wall to find something that sticks. They are specifically going after yuzu via a fairly well tested part of the DMCA.

The DMCA allows them this, and if you don’t feel like nintendo or anyone else should get to dictate what device you play the games you own on, you should be looking into whatever you can do to pressure your representatives to add to the many exceptions of that dmca clause for this purpose.
