Here is a refresher about the recent indictment and charges related to Special Counsel Jack Smith’s investigation into the January 6th insurrection.

Trump pushed the big lie that the election was stolen. Trump lost in the courts^[1] including the Supreme Court.^[2] Then he tried to pressure state officials.^[3] He tried to pressure Pence.^[4]

So what does Trump do after exhausting all nonviolent methods of overturning the election? Trump turns to his supporters and lights them up making inflammatory statements such as;

  • We are going to fight for the survival of the nation.
  • Now is not the time to retreat, its to fight harder.
  • We will never give in, never back down, never surrender.
  • We will fight like hell.
  • You have to get your people to fight.

Trump primed them for weeks.

State officials had started getting death threats weeks before the attempted insurrection following the general election.^[5] Trump saw first hand what violence was being created as his supporters rioted and vandalized black churches in Washington back in December.^[6]

Trump didn’t stop his incitement after the initial violence, he got more specific. He told his supporters how, when, and where. He gave them 18 days notice inviting them to the rally telling them to be there, that it will be wild.^[7] And on the day of the insurrection Trump told his supporters to march on the Capitol and fight like hell.

Following the riot Trump continued to promote the big lie that had incited the insurrection. After the mob was dispersed, Trump praised and sympathized with the mob in a video he released, claiming once again that the election had been stolen.^[8] Then he praised the insurrection in a tweet after the mob had been dispersed. He told his mob to remember Jan. 6 forever. He said that he loved the insurrectionists and that the violent mob were special people.

In a phone call, Trump tried to pressure officials in Georgia into making tens thousands of votes disappear to try and steal the 2020 election. They found no illegal votes, refused to overturn the results and began receiving death threats from Trump’s supporters.^[1]

After Trump had exhausted all legal forms of overturning the election; From having over 60 frivolous lawsuits thrown out from all levels of courts including the conservative leaning Supreme Court (Trump picked 3 justices out of 9), and after his Attorney General Barr resigned (an individual that covered/stalled investigations for Trump), Trump turned to his stalwart supporter in Vice-President Pence. A lie was pushed that Mike Pence could refuse to certify the election results as he presided over the counting of the ballots of the electoral college during the joint session of Congress on Jan. 6. Pence refused this illegal power grab. Having no further recourse Trump incited an insurrection during a rally Trump held at the same time the E.C. ballots were being certified. Trump’s supporters erected a gallows, stormed the capital where several people subsequently lost their lives including police officers. Politicians were incredibly lucky they escaped. For example Capitol Police Officer Goodman’s quick and heroic decision to lead an angry mob away from where congression members were hiding probably saved many lives. This mob was chanting hang Mike Pence, many of whom wore tactical gear, carried zip ties, and used flagpoles, fire extinguishers, and chemical sprays as weapons while attacking police officers that protected Congress.^[2]

It’s pretty dumb for RA to go after NCD, I clicked on far too many NSFW posts without realizing what it was as they weren’t labeled. The arguments NCD mods present with sources are true. I feel like it’s reddit just trying to stem the loss of money. Their IPO valuation has lost 41% of its value in a year^[1] and now their bottom line is being affected because users realized advertisements aren’t shown on NSFW subs.^[2]

The sequence of events from Elon Musk acquiring Twitter to now is an incredible journey.

  • Elon Musk bought a social media company for tens of billions, attempted to back out of the deal but couldn’t because of his ineptitude by signing away the ability to reneg on the deal.^[1]
  • Then there was the freedom of speech advocacy from Musk where he ultimately unbanned racists and then began sharing bigoted Tweets. But it’s only freedom of speech for his bigoted supporters, when authoritarian governments ask Musk to censor people/tweets he abides by their requests.^[2]
  • The site becomes inundated with the alt right, it’s become rife with bigotry.^[3]
  • There was the whole verified blue check mark debacle where verification became something you could pay for, with people making fake “official” accounts. For example a fake account impersonating a pharmaceutical company caused their stock to drop abruptly following a satirical tweet.^[4]
  • Twitter engages in mass layoffs and multiple things break on the site. There are also reports that they can’t pay rent in certain locations across the globe. Twitter is hemorrhaging advertisors, as they record a 59% reduction in advertisement sales.^[5]
  • Elon Musk posts tweets seemingly apologizing for some of the changes and says he will follow the will of the people by posting polls for users to vote on policy changes. Musk asks if he should step down, to which the majority vote in favour of his removal. He then goes on a tirade about bots after losing in the poll. He goes on to say that only paid subscribers will be permited to vote in future polls. Vox Populi, Vox Dei.^[6]
  • The crème de la crème is Elon Musk implementing a new restriction where you have to be logged in to see tweets and restricting the number of tweets you can view. Inadvertently DDOSing his own site.

This isn’t entirely the fault of the FTC, much of the underlying problems are because of the courts.

The FTC under Biden has been going after many different industries, from aviation to publishing, while the DoJ has been trying to stop mergers in fields such as healthcare and food. Both the FTC and DoJ have lost many cases in the courts in recent years. For example, the DoJ went after chicken producers for price fixing, but the jury ruled that they were innocent. Both the DoJ and the FTC lost over half a dozen cases just last year.^[1]

It’s become pretty common for companies to prepare for litigation, they no longer believe that cooperating with antitrust agencies to negotiate a settlement is feasible under the current administration.

The current administration is litigating most mergers, and has had some success. For example the DoJ successfully stopped both Lockheed Martin and NVIDIA from buying competitors while the FTC blocked healtchare company mergers in some states.

But now the Supreme Court has passed a decision that would allow companies to shop for judges so that they can challenge the constitutional authority of federal regulators like the FTC and EPA.^[2]
