As far as I’m aware nothing will stop them from trying to do that. It’s up to the judge (or judges if it goes to an appeal) to decide whether their argument makes sense. While I’d hope that a competent judge will see their shenanigans for what it is, I have no doubt that someone has made that strategy work at some point.

To be clear, I’m not a lawyer, so naturally don’t take my word for it.

I suspect that they were intended to lure those on YT who might be more sympathetic to the idea of a “Deep State” as expounded upon by those on the far right in hopes to enlighten some about what the real deep state looks like. It’s fair to say that Lemmy, at least this instance, tends to lean the other way, so perhaps a different title would have been more appropriate here.

The Supreme Court is the final appeals court, so it makes sense that they can be asked to review cases like this. However, in this case I certainly hope they do the logical thing and pass on hearing this case since the appeals court clearly got it right.
